There is no requirement for either a minimum or a maximum number of suppliers or contractors parties to a framework agreement.
10- ولا يوجد شرط بعدد أدنى ولا أقصى من المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري.

Written invitations to present submissions should be issued to all suppliers or contractors party to the framework agreement.
وقالت إنَّ الدعوات الكتابية إلى تقديم العروض يجب أن توجّه إلى جميع المورّدين أو المقاولين الأطراف في الاتفاق الإطاري.

وأُشير أيضا إلى الاستخدام العملي للاتفاقات الإطارية لدى هيئات الاشتراء المركزية، التي يمكن أن تتكبد تكاليف مرتفعة إذا طُولبت بدعوة كثير من المورِّدين الأطراف في الاتفاق الإطاري وبمعالجة أعداد كبيرة من العروض المقدَّمة من جهات غير قادرة على تلبية احتياجات الجهة المشترية.

It was further explained that, if some suppliers or contractors parties to the framework agreement indicated to the procuring entity from the outset of the procurement proceedings their limited capacity to deliver certain parts of the subject matter of the procurement, it would be inappropriate for the procuring entity to invite them.

For example, providing an estimated value of procurement during the entire duration of the framework agreement may be necessary to allow suppliers or contractors parties to the framework agreement to stock the subject matter of the framework agreement accordingly to ensure security of supply.

7. The provisions of subparagraph (a) require all suppliers or contractors parties to the framework agreement to be invited to participate or, where relevant, only those " capable " of fulfilling the procuring entity's requirements.
7- وتقضي أحكام الفقرة الفرعية (أ) بدعوة جميع المورّدين أو المقاولين الأطراف في الاتفاق الإطاري إلى المشاركة أو بالاكتفاء، عند الانطباق، بدعوة من كان منهم " قادرا " على الوفاء بمتطلبات الجهة المشترية.

5. The procurement regulations must guide the procuring entity as regards the need in some cases to conclude separate agreements with individual suppliers or contractors that are parties to the framework agreement.
5- ويجب على لوائح الاشتراء أن توجه الجهة المشترية بشأن الحاجة في بعض الحالات لإبرام اتفاقات منفصلة مع فرادى المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري.

(f) If the procuring entity intends to enter into a framework agreement with more than one supplier or contractor, a statement that the suppliers or contractors that are parties to the framework agreement will be ranked according to the selection criteria specified;
(و) بياناً بأن المورّدين أو المقاولين الأطراف في الاتفاق الإطاري سيرتَّبون وفقا لمعايير الاختيار المحددة، إذا كانت الجهة المشترية تعتزم إبرام اتفاق إطاري مع أكثر من مورّد أو مقاول واحد؛

65. As regards paragraph (d), it was agreed that the requirement for a statement of the maximum and minimum number of parties to the framework agreement would assist in guaranteeing competition, but that the drafting should be clarified.
65- وفيما يتعلق بالفقرة (د)، اتُّفق على أن الحكم الذي يشترط تقديم بيان بالحد الأقصى والحد الأدنى لعدد الأطراف في الاتفاق الإطاري يساعد على ضمان التنافس، ولكن ينبغي توضيح صيغته.

Subparagraph (a) requires the issue of an invitation to the competition to all parties of the framework agreement or only those then capable of meeting the needs of the procuring entity in the subject matter of the procurement.

20- الرئيس بالنيابة: قال إنَّ هناك اتفاقا، فيما يبدو، على أن يتلقّى الأطراف في الاتفاق الإطاري كافة إشعارات بشأن التنافس في المرحلة الثانية.

To that end, the procuring entity should be permitted to identify in advance those suppliers or contractors party to the framework agreement which it considered to be capable of meeting its needs and to issue the written invitation to present submissions only to them.
وتحقيقاً لهذه الغاية، ينبغي أن يُسمح للجهة المشترية بأن تحدّد مسبقا المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري الذين ترى أنهم قادرين على تلبية احتياجاتها وأن تُوجِّه الدعوات الكتابية لتقديم العروض إلى أولئك المورِّدين أو المقاولين دون غيرهم.
