(a) Ensure the implementation of Organizational Act 4/2000 and other laws by providing to unaccompanied foreign children access to residential care, education, emergency services and other health care, and temporary residency documents;
(أ) ضمان تنفيذ القانون التنظيمي 4/2000 وغيره من القوانين بتمكين الأطفال الأجانب غير المصحوبين من الحصول على الرعاية السكنية والتعليم والخدمات في حالات الطوارئ والأشكال الأخرى للرعاية الصحية والحصول على وثائق الإقامة المؤقتة؛

9- ترحب اللجنة بالجهود التي بذلتها الدولة الطرف لمواءمة تشريعها مع مبادئ الاتفاقية وأحكامها، لكنها تلاحظ أن القوانين والأنظمة المطبقة في الأقاليم المتمتعة بالحكم الذاتي تختلف عن الاتفاقية ولا تتسق دوماً معها في مجالات هامة، مثل حماية الأطفال المعرضين للخطر أو المهملين أو المودعين لدى أسر حاضنة أو معاملة الأطفال الأجانب غير المصحوبين.

54. ECPAT stated that unaccompanied foreign children from non-EU states who were identified as victims of trafficking were considered as adults if they were over the age of sixteen years, in accordance with the Residence Act (2007), thus denying them access to protection and assistance available to German children and children from other EU states.

(b) The Committee urges the State party to protect unaccompanied alien children and to avoid the unsupervised release of such children into the general population.
