Generally speaking, the Special Rapporteur has found children deprived of their liberty to be at a very high risk of illtreatment.
وقد وجد المقرِّر الخاص عموما أن الأطفال المجردين من حريتهم معرضون بدرجة كبيرة إلى سوء المعاملة.

In two cases - children deprived of their liberty and Traveller children - schooling ought to be provided where the children are.
وهناك حالتان ينبغي فيهما توفير التعليم حيث يوجد الأطفال، هما حالة الأطفال المجردين من حريتهم وحالة أطفال الترحال.

(h) Ensure that all children deprived of liberty have effective access to education and health services, including mental health care; and
(ح) ضمان حصول جميع الأطفال المجردين من حريتهم على الخدمات التعليمية والصحية، بما فيها الرعاية الصحية النفسية؛

(b) Consider deprivation of liberty only as a measure of last resort and for the shortest possible period of time, protect the rights of children deprived of their liberty and ensure that children remain in contact with their families while in the juvenile justice system;
(ب) اعتبار الحرمان من الحرية إجراء الملاذ الأخير ولأقصر مدة ممكنة، وحماية حقوق الأطفال المجردين من حريتهم، وضمان بقاء الأطفال على اتصال بأسرهم أثناء خضوعهم لنظام قضاء الأحداث؛

90. The Committee on the Rights of the Child, in its concluding observations on the report of Morocco expressed concern over the situation in relation to the administration of juvenile justice, in particular that children aged between 16 and 18 are treated as adults and that children deprived of their liberty are not separated from adults.
90- أعربت لجنة حقوق الطفل، في ملاحظاتها الختامية بشأن تقرير المغرب، عن قلقها إزاء حالة إدارة قضاء الأحداث، ولا سيما معاملة الأطفال المتراوحة أعمارهم بين 16 و18 عاماً معاملة البالغين، وعدم فصل الأطفال المجردين من حريتهم عن البالغين.

Recognizing that the majority of children deprived of their liberty are in police custody or pretrial or preventive detention and that those children might be at risk of violence, Member States are urged, as appropriate and while taking into consideration relevant international human rights instruments:
٣7- تُحثُّ الدول الأعضاء، إقراراً منها بأنَّ غالبية الأطفال المجردين من حريتهم يُحتجزون لدى الشرطة أو يُحتجزون احتجازاً سابقاً لمحاكمتهم أو احتجازاً احتياطياً وبأنَّ هؤلاء الأطفال يكونون عرضة لمخاطر عنف، على القيام، عند الاقتضاء ومع مراعاتها صكوكَ حقوقِ الإنسان الدوليةَ ذاتَ الصلة، بما يلي:

Recognizing that the majority of children deprived of their liberty are in police custody or pre-trial or preventive detention and that those children are often at higher risk of violence, Member States are urged:
٣٥- تُحثُّ الدول الأعضاء، إقراراً منها بأنَّ غالبية الأطفال المجردين من حريتهم يُحتجزون لدى الشرطة أو يُحتجزون احتجازاً سابقاً لمحاكمتهم أو احتجازاً احتياطياً وبأنَّ هؤلاء الأطفال يكونون عرضة لمخاطر عنف أشد، على ما يلي:

(b) Protect the rights of children deprived of their liberty and improve their conditions of detention and imprisonment, notably by establishing special detention centres for persons below 18 with conditions suitable to their age and needs and by ensuring the existence of social services in all the juvenile detention centres in the country;
(ب) حماية حقوق الأطفال المجردين من حريتهم وتحسين ظروف احتجازهم وحبسهم، ولا سيما بإنشاء مراكز احتجاز خاصة بمن هم دون سن الثامنة عشرة مع توفير الظروف الملائمة لأعمارهم واحتياجاتهم وضمان وجود خدمات اجتماعية في جميع مراكز احتجاز الأحداث في البلد؛

(a) Protect the rights of children deprived of their liberty and improve their conditions of detention and imprisonment, notably by establishing special facilities for children with conditions suitable to their age and needs and by ensuring the existence of social services in all those facilities, and guarantee separation from adults in all pre-trial and other detention centres;
(أ) حماية حقوق الأطفال المجردين من حريتهم وتحسين ظروف احتجازهم وحبسهم، وخاصة بإنشاء مرافق خاصة للأطفال تكون ظروفها مناسبة لأعمارهم واحتياجاتهم، وضمان وجود الخدمات الاجتماعية في جميع هذه المرافق؛ وفصل الأطفال عن الكبار في جميع مراكز الحجز السابق للمحاكمة وغيرها من المراكز؛

To many children deprived of their liberty, the above norms, with their envisaged protection and conditions, must sound as if they are out of touch with reality. Too many of the children whom the Special Rapporteur met on his visits were held in severely overcrowded cells, under deplorable sanitary and hygienic conditions.
وبالنسبة للعديد من الأطفال المجردين من حريتهم، فإن المعايير المذكورة أعلاه بما تتضمنه من حماية وظروف مرتآة تبدو غير ذات صلة بالواقع الحقيقي، فثمة أطفال كثيرون بشكل مفرط من الذين قابلهم المقرِّر الخاص خلال زياراته كانوا محتجزين في زنزانات شديدة الاكتظاظ، وفي ظروف مؤسفة من ناحية المرافق الصحية والنظافة العامة.

In addition, the Council of Europe has recently published European Rules for Juvenile Offenders subject to Sanctions or Measures. The Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment has recently concluded that to many children deprived of their liberty, the above norms, with their envisaged protection and conditions, must sound as if they are out of touch with reality.

(d) Protect the rights of children deprived of their liberty and improve their conditions of detention and imprisonment, including by addressing the problem of overcrowding in prisons and establishing special prisons for children with conditions suited to their age and needs, and in the meantime guarantee that all persons under 18 are separated from adults in prisons and places of pre-trial detention throughout the country;
(د) أن تحمي حقوق الأطفال المجردين من حريتهم وأن تحسن من ظروف احتجازهم وسجنهم، بما في ذلك من خلال معالجة مشكلة اكتظاظ السجون وإنشاء سجون خاصة للأطفال تُهيأ فيها ظروف تناسب سنهم واحتياجاتهم، وأن تكفل في الوقت نفسه الفصل بين الأشخاص دون الثامنة عشرة والبالغين في جميع السجون وأماكن الحبس السابق للمحاكمة في جميع أرجاء البلد؛
