It was also recalled that the International Court of Justice, in its decision on Democratic Republic of the Congo v. Uganda, held that Uganda had violated its obligations under the Convention on the Rights of the Child and the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict by its recruitment and failure to prevent recruitment of children in areas under Ugandan control.
وذُكر كذلك أن محكمة العدل الدولية رأت في قراراها في قضية جمهورية الكونغو الديمقراطية ضد أوغندا أن الأخيرة خالفت التزاماتها بموجب اتفاقية حقوق الطفل وبروتوكولها الاختياري المتعلق بإشراك الأطفال في النزاعات المسلحة، وذلك بتجنيدها للأطفال وعدم منعها تجنيد الأطفال في مناطق تقع تحت سيطرتها.

وكما قالت اللجنة الوطنية الهندية لحماية حقوق الطفل في " بروتوكولاتها للشرطة والقوات المسلحة التي تتعامل مع الأطفال في مناطق الاضطرابات المدنية " ، يُحتجَز في غالب الأحيان الأطفال الذين يُلقى القبض عليهم بموجب التشريعات الأمنية مَعَ البالغين، ولا يُحاكَمون من خلال نظام قضاء الأحداث، ويُحرَمون من الاستفادة من الإجراءات القانونية الواجبة.

In closing, he expressed encouragement that, in recognition of the hardships faced by children in areas of armed conflict, the United Nations Department of Peacekeeping Operations had adopted a child protection policy directive on mainstreaming the protection, rights and well-being of children affected by armed conflict and had assigned a child protection adviser to each peacekeeping mission.
وفي الختام، أعرب عن ارتياحه لأن إدارة الأمم المتحدة لعمليات حفظ السلام، اعترافا منها بالصعوبات التي يواجهها الأطفال في مناطق النزاع المسلح، اعتمدت توجيها سياساتيا بشأن تعميم حماية الأطفال المتأثرين بالنزاع المسلح وتعزيز حقوقهم ورفاهيتهم، وانتدبت مستشارا معنيا بحماية الأطفال للعمل في كل بعثة من بعثات حفظ السلام.

The armed forces have published a guide to putting children on the military agenda, which was developed on the basis of the training model published by Save the Children Sweden in cooperation with UNICEF. The guide sets out fundamental principles under the provisions of the Optional Protocol in order to help armed forces personnel in dealing with children in areas of armed conflict.
وقد أصدرت القوات المسلحة مرشداً خاصاً بإدراج الأطفال في الأجندة العسكرية والذي تم تطويره وفقاً للدليل التدريبي الذي صدر بالتعاون مع منظمة رعاية الطفولة السويدية واليونيسيف، حيث تضمن المرشد مبادئ أساسية وفقاً لأحكام البروتوكول الاختياري لإرشاد منسوبي القوات المسلحة إلى كيفية التعامل مع الأطفال في مناطق النزاعات المسلحة.

(d) The Law includes an entire chapter on the protection of civilians, including children, in areas of armed conflict. Non-compliance with this chapter can lead to life imprisonment or the death penalty (chapter II, section III, of the Armed Forces Act).
