The Committee expresses its concern at the low age of marriage, which can be 14 years of age with the judge's permission, and at the wide variety of minimum ages in civil matters in the various Autonomous Communities.
490- تعرب اللجنة عن قلقها إزاء انخفاض سن الزواج، الذي يمكن أن يصل إلى 14 سنة بإذن من القاضي، وإزاء التنوع الكبير في الأعمار الدنيا في ما يتعلق بالمسائل المدنية في مختلف المجتمعات المستقلة ذاتيا.

The Committee recommends that the State party review its legislation with a view to increasing the minimum age of marriage and harmonizing minimum ages for civil matters in the various Autonomous Communities.
491- توصي اللجنة بأن تعيد الدولة الطرف النظر في قوانينها بغية رفع السن الأدنى للزواج وتحقيق المواءمة بين الأعمار الدنيا في المسائل المدنية في مختلف المجتمعات المستقلة ذاتيا.

691. While noting that the Child Rights Act provides a clear definition of the child, the Committee remains concerned at the wide variety of minimum ages that exist in the states of the State party, including unclear definitions of the child, and that many of these minimum ages are too low.

While noting the statement of the delegation that the State party intends to increase the minimum age of marriage for girls to 18 years, the Committee remains concerned at the disparity in the minimum ages of marriage for boys (18 years) and girls (15 years).

These minimum ages should be the same for boys and girls (article 2 of the Convention) and closely reflect the recognition of the status of human beings under 18 years of age as rights holders, in accordance with their evolving capacity, age and maturity (arts. 5 and 12 to 17).
وينبغي أن تكون هذه الأعمار الدنيا غير تمييزية بين الفتيان والفتيات (المادة 2 من الاتفاقية)، كما ينبغي أن تعكس عن كثب الاعتراف بوضع كلِّ إنسان لم يتجاوز عمره الثامنة عشر بوصفه صاحب حق، وفقاً لقدراته المتطوِّرة وسنه ونضجه (المواد 5 و12 إلى 17).

CRC recommended that Trinidad and Tobago proclaim as a matter of priority the amendment to the Age of Majority Act of 2000, and make the necessary efforts to harmonize the various minimum ages and definitions of the child in its legal order to recognize that all persons below 18 are entitled to special protection measures and specific rights as enshrined in the Convention.
وأوصت اللجنة المذكورة بأن تعلن ترينيداد وتوباغو أن التعديل على قانون سن الرشد لعام 2000 يكتسي أولوية، وأن تبذل الجهود اللازمة لتنسيق مختلف الأعمار الدنيا وتعاريف الطفل في نظامها القانوني للاعتراف بأنه يحق لجميع الأشخاص دون 18 سنة الانتفاع بتدابير الحماية الخاصة والحقوق المحددة المنصوص عليها في الاتفاقية(19).

In order to improve the situation the Committee reiterates its recommendation (para. 12) that the State party should undertake all possible measures to have the Child Rights Act enacted in all states of the State party, and urges the State party to continue and strengthen its efforts to further harmonize the various minimum ages and/or definitions in its domestic legislation and set them at an internationally acceptable level.
692- من أجل تحسين الحالة، تكرر اللجنة توصيتها (الفقرة 676) بأن تتخذ الدولة الطرف جميع التدابير الممكنة لسن واعتماد قانون حقوق الطفل في جميع ولايات الدولة الطرف، وتحث الدولة الطرف على أن تواصل وتعزز جهودها الرامية إلى زيادة مواءمة مختلف الأعمار الدنيا و/أو التعاريف في تشريعاتها المحلية وجعلها عند مستوى مقبول دولياً.
