9- وفي رأي اللجنة، أنه يجب على الدول الأطراف ألا تعرض الأفراد لخطر التعذيب أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة لدى رجوعهم إلى بلد آخر عن طريق التسليم أو الطرد أو الرد.

7.8 With regard to article 7 of the Covenant, the Committee recalls that States parties must not expose individuals to the risk of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by virtue of their extradition, expulsion or refoulement.

A reference was also made to general comment No. 20 (1992) of the Human Rights Committee, according to which States parties to the International Covenant on Civil and Political Rights " must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement " .

According to general comment No. 20 of the Human Rights Committee, to which an express reference would be appropriate, States must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

For example, at the universal level, general comment No. 20 of the Human Rights Committee indicated that " States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement " .

14.2 As to whether the author's extradition to Kyrgyzstan exposed him to a real risk of torture or ill-treatment, the Committee observes that States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

At the universal level, it is reflected in general comment No. 20 of the Human Rights Committee to the effect that " States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement. "

With respect to allegations under article 7, the State party recalls that " State parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement " .

(16) While the Committee acknowledges the long history of the State party as a host country for refugees from the region as well as it efforts in resettling and integrating these populations, it remains deeply concerned that the current refoulement procedures and practices may expose individuals to the risk of torture.

(c) Operative paragraph 6 (j), which read: " Not to expose individuals to danger of cruel, inhuman or degrading treatment or punishment by way of return to another country insofar as such an act runs contrary to their obligations under international law " ;
