At its fifty-first session, in 1999, the International Law Commission decided that the Secretariat, in consultation with the Special Rapporteur on the topic " unilateral acts of States " , should elaborate and send to Governments a questionnaire requesting materials and inquiring about their practice in the area of unilateral acts, as well as their position on certain aspects of the Commission's study on the topic.

In one view, it was regrettable that the Commission's projected study on the topic did not seem to include unilateral acts of States in the form of the unilateral enactment of domestic laws having extraterritorial effects on other States and in turn affecting other forms of international relationships, including commercial and financial ones, whether with third States or their nationals.
