Similarly, paragraph 52 should be deleted, as there was no need to focus on UNCITRAL Conciliation Rules or to enter into a discussion on national laws.

It was explained that, for that reason, article 16 of the UNCITRAL Conciliation Rules allowed a party to initiate arbitral or judicial proceedings where, " in his opinion " , such proceedings were necessary for preserving rights.
وأُوضِح بأن ذلك السبب هو الذي جعل المادة 16 من قواعد الأونسيترال للتوفيق تسمح للطرف باستهلال إجراءات تحكيمية أو قضائية حيثما " رأى " أن تلك الإجراءات ضرورية للحفاظ على حقوقه.

With respect to paragraph 9, it was suggested that the Guide should make it clear that procedural issues such as the admissibility of evidence in judicial or arbitral proceedings was not governed mainly by rules such as the UNCITRAL Conciliation Rules but by applicable statutory law.
وفيمــا يتعلــق بالفقـرة 9، اقترح أن يوضح الدليل أن المسائل الاجرائية مثل مقبولية الأدلة في اجراءات قضائية أو تحكيمية، لا تحكمها بشكل رئيسي قواعد مثل قواعد الأونسيترال للتوفيق وانما ينظمها القانون التشريعي المنطبق.

It was generally felt that paragraph 52 should be deleted, since there was no need for the Guide to restate the UNCITRAL Conciliation Rules or to discuss the merits of national laws in the context of that article.
159- وارتئي عموما أنه ينبغي حذف الفقرة 52، لأنه ليس هناك حاجة إلى أن يعيد الدليل ذكر قواعد الأونسيترال للتوفيق أو مناقشة ميزات القوانين الوطنية في سياق تلك المادة.
