Amendments to the Rules of Procedure and Evidence, which lay down a framework for the admission of statements from other trials and impose stricter judicial controls on motions, will all help to speed up court proceedings.
وسوف تساعد على الإسراع بإجراءات المحكمة التعديلات التي أُدخلت على قواعد الإجراءات وقواعد الإثبات، وهي التعديلات التي تضع إطارا لقبول أقوال وردت في محاكمات أخرى وفرض ضوابط قضائية أكثر صرامة على تقديم الطلبات.

We are pleased to note that as a result of the reforms it has undertaken, the Tribunal has accelerated its work and improved its procedures through amendments to the Rules of Procedure and Evidence.
كما يسرنا أن المحكمة نتيجة لما اضطلعت به من إصلاحات قد زادت من سرعة عملها وحسَّنت إجراءاتها من خلال إدخال تعديلات على قواعد الإجراءات وقواعد الأدلة.

The difficulties include not only the definition of the crimes but also the way in which the crimes are investigated by the police, the basis of decisions regarding prosecution, the rules of Procedure and the rules of evidence.

The Appeals Chamber stated that the correct test for determining whether certain material is to be considered as exculpatory within the meaning of rule 68 of the Rules of Procedure and Evidence is " whether there is any possibility, in light of the submissions of the parties, that the information could be relevant to the defence of the accused " .

61. Ms. Hampson said that NGOs had a great deal of experience regarding children giving evidence in cases of sexual assault and that the rules of Procedure and the law of evidence in that regard had changed dramatically in the last 20 years in certain jurisdictions.

30. In accordance with rule 23 of the Rules of Procedure and Evidence, the President consults the members of the Bureau on all major questions relating to the functioning of the Tribunal. The Chef de Cabinet acts as Executive Secretary of the Bureau and prepares, inter alia, the meetings organized after consulting all the members.

14. On 19 April 2012, Jean Uwinkindi became the first accused in the custody of the Tribunal to have been transferred to Rwanda for trial under rule 11 bis of the Rules of Procedure and Evidence after the Appeals Chamber confirmed the referral of the case on 16 December 2011.

This entailed making preparations for the commencement of functioning of the Special Tribunal on 1 March 2009; for the swearing in of the judges, the Prosecutor, the Registrar and the Head of the Defence Office; and for the adoption of the Rules of Procedure and Evidence of the Special Tribunal.

In paragraph 12 (g), while acknowledging the improvements recently designed or implemented for granting legal aid and managing defence counsel bills, the Board was of the opinion that the provisions of the Rules of Procedure and Evidence and the way in which they were applied had so far limited the cost-effectiveness of the management of legal aid and of overall budget control.
741- في الفقرة 12(ز) رغم تسليم المجلس بالتحسينات التي وضعت أو نفذت مؤخرا لتقديم المعونة القانونية والحد من فواتير محامي الدفاع، فإنه يرى أن أحكام قواعد الإجراءات وقواعد الإثبات، والطريقة التي تطبق بها، حــدّت حتى الآن من فعالية تكاليف إدارة المعونة القانونية وضبط الميزانية بصورة عامة.

The Commission recommends that the Assembly of States Parties await any further developments on this issue, including the finalization of the constitution of this body, before taking further steps in accordance with rule 20(3) of the Rules of Procedure and Evidence, and to this end to include this item on its agenda at the appropriate time.

46. procedures and rules of evidence in the criminal justice system are often infiltrated by strong gender stereotypes which can result in engagement in gender-biased behaviour by court officials and discrimination against women by the criminal system in general.
