استخدام الإفادات التي يتم الإدلاء بها نتيجة التعذيب

The Committee notes that, under that provision, the State party must ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings.

The State party should take the necessary legislative and administrative measures to ensure that any statement that is found to have been made as a result of torture may not be directly or indirectly invoked as evidence in proceedings, in accordance with article 15 of the Convention.

47. According to article 15 of the Convention, only those statements are inadmissible as evidence which are " established to have been made as a result of torture " .
47 - ووفقا للمادة 15 من الاتفاقية، لا يكون من الأقوال غير مقبول كأدلة إلا تلك التي " يثبت أنه تم الإدلاء بها نتيجة للتعذيب " .

The Court based this decision on the reasoning that article 15 only excluded statements as evidence which were established to have been made as a result of torture, but that in the present case it was impossible for the Court to establish that the testimonies had in fact been extracted by torture.
واستندت المحكمة في قرارها هذا إلى المنطق القائل بأن المادة 15 تستثني من الأدلة فقط الأقوال التي يثبت أنه تم الإدلاء بها نتيجة للتعذيب، إلا أنه كان من المستحيل في هذه القضية أن تثبت المحكمة أن الشهادات قد انتُزعت عن طريق التعذيب فعلا.

It should be recalled that according to article 15 of the Convention against Torture, States Parties shall ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings, except against a person accused of torture as evidence that the statement was made.
وينبغي أن نشير إلى أنه وفقا للمادة 15 من اتفاقية مناهضة التعذيب فإن الدول الأطراف تضمن عدم الاحتجاج بأية أقوال يثبت الإدلاء بها نتيجة للتعذيب، كدليل في أية إجراءات، إلا إذا كان ذلك ضد شخص متهم بارتكاب التعذيب كدليل على الإدلاء بهذه الأقوال.

The Committee observes that, under article 15 of the Convention, the State party has accepted the obligation of ensuring that any statement that is established to have been made as a result of torture shall not be invoked as evidence in any proceedings, and therefore the submission by the complainant relates to the merits of his allegations under article 15 of the Convention.
وتلاحظ اللجنة أن الدولة الطرف قد قبلت بموجب المادة 15 من الاتفاقية، الالتزام بضمان عدم الاستشهاد بأية أقوال يثبت أنه تم الإدلاء بها نتيجة للتعذيب كدليل في أية إجراءات، وعليه فإن بلاغ صاحب الشكوى له صلة بالأسس الموضوعية للادعاءات التي تستند إلى المادة 15 من الاتفاقية.

The prohibition of torture is jus cogens, and article 15 of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment provides that statements that are established to have been made as a result of torture shall not be invoked as evidence in any proceedings.
ويتخذ حظر التعذيب طابع القواعد الآمرة، وتنص المادة 15 من اتفاقية الأمم المتحدة لمناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة على ألا يستشهد كدليل في أي محاكمة بأي أقوال يثبت أنه تم الإدلاء بها نتيجة التعذيب.

130. Further, article 15 of the Convention against Torture provides that “Each State Party shall ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings, except against a person accused of torture as evidence that the statement was made”.

This follows from the wording of article 15 which obliges the State party to " ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings " .
