Noting the adoption of the Universal Declaration on Cultural Diversity and the Action Plan for its implementation, adopted by the General Conference of the United Nations Educational, Scientific and Cultural Organization on 2 November 2001,

The Universal Declaration on Cultural Diversity (2001) emphasizes the role of consolidating cultural diversity as an ethical imperative and reminds States of the position of indigenous peoples within that diversity.

We acknowledge the fundamental importance of cultural diversity as a source of enrichment for humankind and a contributor to sustainable development of local communities, peoples and nations, and in this regard recall the principles of the 2001 United Nations Educational, Scientific and Cultural Organization Universal Declaration on Cultural Diversity.

In particular, this entails, as enshrined in the Universal Declaration on Cultural Diversity (art. 4), and reiterated in resolution 10/23 of the Human Rights Council (para. 4), that no one may invoke cultural diversity to infringe upon human rights guaranteed by international law, nor to limit their scope.

The Universal Declaration on Cultural Diversity and the Convention on the Protection and Promotion of the Diversity of Cultural Expressions propose measures for the protection of cultural diversity, based, in particular, on the principle that cultural goods and services, as vectors of identity, values and meaning, must not be treated as mere commodities or consumer goods.

In particular, the Universal Declaration on Cultural Diversity affirms in article 3 that " cultural diversity widens the range of options open to everyone; it is one of the roots of development, understood not simply in terms of economic growth, but also as a means to achieve a more satisfactory intellectual, emotional, moral and spiritual existence " .

The independent expert proposes to analyse further the content of the right of all persons to " quality education and training that fully respect their cultural identity " , as enshrined in the Universal Declaration on Cultural Diversity (art. 5), taking into consideration general comment No. 13 (1999) of the Committee on Economic Social and Cultural Rights on the right to education.
