Since Mr. Bialatski's arrest and detention were based on provisions of Belarusian criminal and criminal procedural law, they cannot be considered to be arbitrary in the sense of article 9 of the Universal Declaration of Human Rights or article 9 of the International Covenant on Civil and Political Rights.
ونظراً إلى أن توقيف السيد بيالاتسكي واحتجازه يستندان إلى أحكام القانون الجنائي وقانون الإجراءات الجنائية لبيلاروس، فلا يمكن اعتبارهما تعسفيين بمفهوم المادة 9 من الإعلان العالمي لحقوق الإنسان أو المادة 9 من العهد الدولي الخاص بالحقوق المدنية والسياسية.

Thus, considering that Mr. Ismonov was found guilty of a serious offence in a manner prescribed by law, his detention is not arbitrary and does not contradict articles 9 or 10 of the Universal Declaration of Human Rights or articles 9 or 14 of the International Covenant on Civil and Political Rights.
وعليه، ونظراً إلى ثبوت إدانة السيد إسمونوف بارتكاب جريمة خطيرة على النحو المنصوص عليه في القانون، فإن هذا الاحتجاز ليس تعسفياً ولا يخالف المادتين 9 و10 من الإعلان العالمي لحقوق الإنسان أو المادتين 9 و14 من العهد الدولي الخاص بالحقوق المدنية والسياسية.

17. On the question of the violation of national legislation mentioned by the Government, the Working Group recalls that, in conformity with its mandate, it must ensure that national law is consistent with the relevant international provisions set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments to which the State concerned has acceded.
17- وبخصوص مسألة خرق التشريع الوطني التي أثارتها الحكومة، يذكر الفريق العامل أن من واجبه، عملاً بالولاية المنوطة به، أن يضمن تمشي القانون الوطني مع الأحكام الدولية ذات الصلة الواردة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي صدقت عليها الدولة الطرف.

29. On the question of the violation of national legislation mentioned by the Government, the Working Group recalls that, in conformity with its mandate, it must ensure that national law is consistent with the relevant international provisions set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments to which the State concerned has acceded.
29- وبخصوص مسألة خرق التشريع الوطني التي أثارتها الحكومة، يُذكِّر الفريق العامل بأن من واجبه، عملاً بالولاية المسندة إليه، أن يضمن تماشي القانون الوطني مع الأحكام الدولية ذات الصلة الواردة في الإعلان العالمي لحقوق الإنسان أو في الصكوك القانونية الدولية ذات الصلة التي صدقت عليها الدولة الطرف.

Specifically, the Government stated that its response showed that Mr. Bialatski's arrest and detention were based on specific provisions of the Criminal Code and Code of Criminal Procedure of Belarus and hence could not be considered arbitrary under article 9 of the Universal Declaration of Human Rights nor article 9 of the International Covenant on Civil and Political Rights.
وأشارت الحكومة بشكل خاص إلى أن ردها أظهر أن توقيف السيد بيالاتسكي واحتجازه يقومان على أحكام محددة من القانون الجنائي وقانون الإجراءات الجنائية في بيلاروس وبالتالي لا يمكن اعتبارهما تعسفيين بموجب المادة 9 من الإعلان العالمي لحقوق الإنسان أو المادة 9 من العهد الدولي الخاص بالحقوق المدنية والسياسية.

With the introduction of the new restrictions and the travel bans for American citizens and Cubans residing in the United States, the United States Government is once again undermining the basic human rights enshrined in the International Bill of Human Rights, the Universal Declaration of Human Rights and both International Covenants.
إن حكومة الولايات المتحدة، إذ تتبنى القيود وأعمال الحظر الجديدة على سفر مواطني الولايات المتحدة والكوبيين المقيمين فيها، تنتهك مرة أخرى حقوق الإنسان الأساسية المجسدة في الميثاق الدولي لحقوق الإنسان سواء في الإعلان العالمي لحقوق الإنسان أو في كلا العهدين الدوليين.
