وبغية خلق مناخ مؤاتٍ لإعمال ذلك الحق، يتعين على الدول الأطراف اتخاذ الخطوات الملائمة لكفالة إدراك ومراعاة القطاع التجاري الخاص والمجتمع المدني لما لحق الشخص في الإفادة من حماية المصالح المعنوية والمادية المترتبة على إنتاجه العلمي والأدبي والفني من آثار على التمتع بحقوق الإنسان الأخرى.

51- ينبغي أن يتولى الفصل في قضايا حق كل إنسان في الإفادة من حماية المصالح المعنوية والمادية المترتبة على أي إنتاج علمي أو أدبي أو فني هو ربّه هيئات قضائية وإدارية مختصة.
