5 - يضع كل طرف تشريعات وطنية/محلية ملائمة لمنع الاتجار غير المشروع والمعاقبة عليه.

Paragraph 5 requires that the provisions are translated into domestic law, stating: " Each Party shall introduce appropriate national/domestic legislation to prevent and punish illegal traffic.
50- تشترط الفقرة 5 أن يتم ترجمة الأحكام في القانون المحلي، فتنص على ' ' يضع كل طرف تشريعات وطنية/محلية ملائمة لمنع الاتجار غير المشروع والمعاقبة عليه.

Of particular relevance to this manual is paragraph 3 of Article 4 of the Convention, which asserts that the parties consider that the illegal traffic in hazardous wastes is criminal, and the associated paragraph 5 of Article 9, which requires each party to introduce appropriate national/domestic legislation to prevent and punish illegal traffic.

Parties to the Convention have, among other things, thus agreed:
24- ومما هو وثيق الصلة بهذا الدليل على وجه الخصوص الفقرة 3 من المادة 4 من الاتفاقية التي تشدد على أن تعتبر الأطراف الاتجار غير المشروع في المواد الخطرة جريمة، والفقرة 5 من المادة 9 المرتبطة بها التي تتطلب من كل طرف أن يدخل العمل بتشريع وطني/محلي ملائم لمنع الاتجار غير المشروع والمعاقبة عليه.

Reference is also made to decision VIII/26 concerning the obligations of Parties, under paragraph 4 of article 4 and paragraph 5 of article 9 of the Convention, to adopt legal, administrative and other measures to implement and enforce the provisions of the Convention, and to prevent and punish illegal traffic.
ومن المواد المرجعية أيضاً المقرر 8/26 الذي يتعلق بالتزامات الأطراف، بموجب الفقرة 4 من المادة 4 والفقرة 5 من المادة 9 من الاتفاقية، فيما يتعلق باعتماد تدابير قانونية وإدارية وغيرها من التدابير لتنفيذ وإنفاذ أحكام الاتفاقية، ولمنع الاتجار غير المشروع والمعاقبة عليه.

39. " Illegal traffic in hazardous wastes or other wastes is criminal " according to article 4 (3) and, under article 9 (5), each Party is required to " introduce appropriate national/domestic legislation to prevent and punish illegal traffic " .
٩٣- وتنص المادة ٤)٣( على أن " الاتجار غير المشروع بالنفايات الخطرة أو بالنفايات اﻷخرى فعل اجرامي " ، وتلزم المادة ٩)٥( كل طرف بأن " يضع تشريعات وطنية/محلية ملائمة لمنع الاتجار غير المشروع والمعاقبة عليه " )١١(.

According to articles 4 and 9 of the Basel Convention, Parties to the Convention " consider that illegal traffic in hazardous wastes or other wastes is criminal " and shall " introduce appropriate national and domestic legislation to prevent and punish illegal traffic. "
5- وفقا للمادتين 4 و9 من اتفاقية بازل، تعتبر أطراف الاتفاقية " الاتجار غير المشروع بالنفايات الخطرة أو بالنفايات الأخرى فعل إجرامي " وسوف " تضع تشريعات وطنية/ محلية ملائمة لمنع الاتجار غير المشروع والمعاقبة عليه " .
