كما ذكِـر في التقرير، فإن إسرائيل هي إحدى الدول الأطراف في الاتفاقية الأوروبية لتسليم المجرمين منذ عام 1967.

Article 12 of this Law provides that extradition may not be granted for a political criminal offence, criminal offence connected with a political criminal offence or a military criminal offence within the meaning of the European Convention on Extradition.
وتنص المادة 12 من هذا القانون على أنه لا يجوز تسليم المطلوبين في الجرائم السياسية، أو الجرائم المتصلة بالجرائم السياسية أو الجرائم العسكرية بالمعنى المقصود في الاتفاقية الأوروبية لتسليم المجرمين.

In process of development of the Law on International Legal Assistance in Criminal Matters regard was had to the provisions of the Council of Europe conventions, and in particular to those of the European Convention on Extradition.

Turkey considered extradition requests in accordance with the international instruments to which it was a party, including the European Convention on Extradition and the Second Additional Protocol to the European Convention on Extradition.

The author also claims a violation of his rights under article 14 inasmuch as the penalty for the offence was less than one year's imprisonment, which means that, under article 2, paragraph 1, of the European Convention on Extradition, and article 2, paragraph 1, of the Law on Passive Extradition, extradition may not be granted.
ويدَّعي صاحب البلاغ أيضاً حدوث انتهاك لحقوقه بموجب المادة 14، لأن العقوبة المخصصة لهذا الجرم لا تتجاوز سنة سجنٍ واحدة، وهذا يعني أن الفقرة 1 من المادة 2 من الاتفاقية الأوروبية لتسليم المجرمين والفقرة 1 من المادة 2 من قانون التسليم المشروط لا تجيزان هذا التسليم.

In the Committee's opinion, the correctness of the decision to extradite to the United Kingdom, which could be contested in the light of article 2, paragraph 1, of the European Convention on Extradition and the Law on Passive Extradition, is beyond the scope of any particular provision of the Covenant.

With regard to the relationship with the countries that are signatories to the European Convention on Extradition of 13 December 1957, it is pointed out that extradition shall be granted in respect of offences that are punishable, under the laws of the requesting Party and those of the requested Party, by deprivation of liberty or detention order for a period of at least one year or by a more severe penalty.

For example, Azerbaijan had acceded to the European Convention on Extradition of the Council of Europe. In addition, over the past year it had detained and extradited more than 30 foreign nationals on the grounds of their connections to the attacks of 11 September.

Extradition procedures in Cyprus are governed by the Extradition of Fugitive Offenders Law No. 97 of 1970 which was enacted immediately after Cyprus became party to the European Convention on Extradition (Ratification Law 95 of 1970), in order to facilitate its implementation.
