75. Under the new article 49, States other than the injured State could request cessation of the internationally wrongful act and guarantees of non-repetition; they could even demand compliance with the obligation of reparation in the interest of the injured State or beneficiaries of the obligation breached.

2. In the cases referred to in article 41, any State may take countermeasures, in accordance with the present Chapter in the interest of the beneficiaries of the obligation breached.
2- يجوز لأي دولة في الحالات المشار إليها في المادة 41 [19] أن تتخذ تدابير مضادة، وفقاً لهذا الفصل، لصالح المستفيدين من الالتزام الذي أخل به.

57. The obligation to offer appropriate assurances and guarantees of non-repetition was understood to arise as a function of the risk of repetition, the gravity of the wrongful act and the nature of the obligation breached.

142 - أعرب عن التأييد أيضا للمقترح الداعي إلى أنه لا ينبغي للدول ذات المصلحة القانونية في أداء الالتزام الذي أخل به أن تحصل على مجموعة أشكال الجبر المتاحة للدول التي لحق بها ضرر فعلي.

In these circumstances, any State would be authorized to take countermeasures " in the interest of the beneficiaries of the obligation breached " with the understanding that more than one State could take these same countermeasures; in other words, they would take on a collective character.
