26- ويشكل ضمان حماية خاصة للأقليات والمهمشين من الجماعات والأفراد عنصراً بالغ الأهمية في الالتزام بمنع التعذيب وسوء المعاملة.

66. The Subcommittee on Prevention of Torture is of the view that the obligation to prevent torture should embrace " as many as possible of those things which in a given situation can contribute towards the lessening of the likelihood or risk of torture or ill-treatment occurring " .
66- وترى اللجنة الفرعية لمنع التعذيب أن الالتزام بمنع التعذيب ينبغي أن يشمل " أكبر قدر ممكن من الأمور التي من شأنها أن تسهم في حالة معينة في تقليل احتمال أو خطر وقوع التعذيب أو سوء المعاملة " ().

Similarly, the Committee against Torture recalled that: " The obligation to prevent torture in article 2 is wide-ranging, " adding that its content is not static since the most effective methods " are in a process of continual evolution " (para. 4) and are " not limited to those measures contained in [...] articles 3 to 16 " (para. 1).

To allow exceptions by the executive branch for purposes other than legal proceedings, or to find other uses for their outcomes, goes plainly against the spirit of the Convention, the International Covenant on Civil and Political Rights and other treaties and standards; against the obligation to prevent torture and other ill-treatment; and against the absolute prohibition of torture and other ill-treatment.
72- وسماح الجهاز التنفيذي باستثناءات لأغراض غير الإجراءات القانونية، أو من أجل إيجاد استخدامات أخرى لنتائج تلك الاستثناءات، يتعارض بوضوح مع روح الاتفاقية والعهد الدولي الخاص بالحقوق المدنية والسياسية وغيرهما من المعاهدات والمعايير؛ ومع الالتزام بمنع التعذيب وغيره من ضروب سوء المعاملة؛ ومع الحظر المطلق للتعذيب وغيره من ضروب سوء المعاملة.

24. Ms. Skarpeteig (Norway) agreed with the Special Rapporteur that ensuring non-discrimination and special protection for vulnerable groups and individuals was a critical component of the obligation to prevent torture and other ill-treatment and shared his concern about reports of sexual abuse and physical violence against homosexual and transgender prisoners.
