To align the text with the final clauses of the 1993 International Convention on Maritime Liens and Mortgages (MLM):
حرصاً على الموازاة بين هذا النص والبنود الختامية للاتفاقية الدولية بشأن الامتيازات والرهون البحرية لعام 1993:

The 1993 Convention on Maritime Liens and Mortgages also lists in article 4, paragraph 1, grounds related to Liens and Mortgages on which claims can be made.
كما أن اتفاقية الامتيازات والرهون البحرية لعام ٣٩٩١ تعدد في الفقرة ١ من المادة ٤ منها اﻷسس المتصلة بالامتيازات والرهون والتي يمكن تقديم الادعاءات بالاستناد إليها.

These Protocols, which are currently in force, deal with the same questions as the Convention on Maritime Liens and Mortgages of 1993 and the new draft Convention on Arrest of Ships, although exclusively with regard to inland navigation vessels.
ويتناول هذان البروتوكولان، المعمول بهما حالياً، اﻷسئلة ذاتها التي تتناولها اتفاقية الامتيازات والرهون البحرية لعام ٣٩٩١ والمشروع الجديد للاتفاقية بشأن حجز السفن، مع أن وإن كان البروتوكولان يعنيان بمسائل مراكب الملاحة الداخلية على سبيل الحصر.

The JIGE agreed that it might be necessary to amend the Arrest Convention in the light of the decisions taken in respect of the draft maritime Liens and Mortgages convention.

172. In the drafting of the 1993 Maritime Liens and Mortgages Convention an attempt was made to grant a totally different right to the recovery of payments due.
٢٧١- وقد بُذلت في صياغة اتفاقية الامتيازات والرهون البحرية لعام ٣٩٩١ محاولة لمنح حق مختلف اختلافاً تاماً بشأن استرداد المبالغ المستحقة.

Arrest being a means of enforcing maritime Liens and Mortgages, it was essential that the international Conventions governing these issues be closely aligned so as to ensure that all claims secured by maritime liens were given right of arrest under the Convention.

The inclusion of Liens and Mortgages - particularly mortgages - as a basis for arrest failed to take full account of those enforcement mechanisms commonly available under the national laws of most maritime nations.
وقال إن إدراج الامتيازات والرهون - لا سيما الرهون - كأساس للحجز لا يراعي تماما آليات اﻹنفاذ المتاحة عادة بموجب القوانين الوطنية لمعظم الدول البحرية.

13. The representative of the International Chamber of Commerce stated that review of the Arrest Convention should go beyond the CMI Draft and take account of the changes brought about by the 1993 Convention on Maritime Liens and Mortgages.

14. Most delegations, however, agreed to take the CMI Draft as a basis for discussion, taking into account changes required by the 1993 Convention on Maritime Liens and Mortgages.

The mandate of the Joint Intergovernmental Group of Experts (JIGE), as approved by the two organizations, included the possible consideration of " the review of the maritime Liens and Mortgages Conventions and related enforcement procedures, such as arrest " .
وتشتمل ولاية فريق الخبراء الحكومي الدولي المشترك، على نحو ما اعتمدته المنظمتان، على إمكان النظر في " تعديل اتفاقيتي الامتيازات والرهون البحرية وإجراءات اﻹنفاذ المتصلة بهما، مثل الحجز " .

8. The approach adopted by the Arrest Convention would probably be in conflict with Article 6 of the International Convention on Maritime Liens and Mortgages, 1993 (hereinafter referred to as the 1993 MLM Convention).
٨- وهناك على اﻷرجح تعارض بين النهج المعتمد في اتفاقية الحجز، والمادة ٦ من الاتفاقية الدولية للامتيازات والرهون البحرية، ٣٩٩١ )والتي يشار إليها هنا باتفاقية الامتيازات والرهون البحرية(.

3. The Officer-in-charge of the Services Development Division of UNCTAD, speaking on behalf of the Secretary-General of IMO and the Officer-in-charge of UNCTAD, congratulated the Joint Group for the excellent work carried out during the six sessions held between 1986 and 1989 in preparing the Draft Convention on Maritime Liens and Mortgages.
٣- أشاد الموظف المسؤول عن شعبة تطوير الخدمات في اﻷونكتاد، متحدثا بالنيابة عن اﻷمين العام للمنظمة البحرية الدولية والموظف المسؤول عن اﻷونكتاد، بفريق الخبراء المشترك للعمل الممتاز الذي اضطلع به أثناء الدورات الست التي عقدها بين عامي ٦٨٩١ و٩٨٩١ ﻹعداد مشروع اتفاقية الامتيازات والرهون البحرية.

The second part of article 9 of the 1952 Convention, which referred to the Convention on Maritime Liens and Mortgages, was considered inappropriate, given the existence of three Conventions on the subject.

The attached report (JIGE(VII)/2)* has been prepared for the seventh session of the Joint Intergovernmental Group, in response to the recommendation of the UN/IMO Conference of Plenipotentiaries on a Convention on Maritime Liens and Mortgages.

(c) Whether, on the assumption that the right of arrest of a ship not owned by the person liable is limited to claims secured by maritime liens, such liens should only be those recognized by the Maritime Liens and Mortgages Convention, or also include the national maritime liens under the applicable law;

2. Following the resolution adopted by the United Nations/IMO Conference of Plenipotentiaries on a Convention on Maritime Liens and Mortgages, See the report of the Conference (A/CONF.162/8), annex I. the Joint Intergovernmental Group of Experts was reconvened in order to examine the possible review of the International Convention for the Unification of Certain Rules Relating to the Arrest of Seagoing Ships, 1952.
٢- اثر القرار الذي اعتمده مؤتمر اﻷمم المتحدة والمنظمة البحرية الدولية للمفوضين لوضع اتفاقية بشأن الامتيازات والرهون البحرية)٢(، اجتمع فريق الخبراء الحكومي الدولي المشترك من جديد للنظر في إمكانية استعراض اتفاقية عام ٢٥٩١ الدولية لتوحيد بعض القواعد المتعلقة بحجز السفن البحرية.

After the Joint Intergovernmental Group of Experts on Maritime Liens and Mortgages and Related Subjects had been established, an observer of the CMI attended all its sessions and through him the CMI gave all possible cooperation and assistance in the preparation of the draft which became the 1993 Convention on Maritime Liens and Mortgages and in the preparation of the draft articles for a Convention on Arrest of Ships.
فبعد إنشاء فريق الخبراء الحكومي الدولي المشترك المعني بالامتيازات والرهون البحرية والمواضيع المتصلة بها، حضر مراقب عن اللجنة البحرية الدولية كل دورات الفريق وأمكن للجنة عن طريق مراقبها أن تقدم كل ما بوسعها من تعاون ومساعدة في إعداد المشروع الذي أصبح اتفاقية عام ٣٩٩١ بشأن الامتيازات والرهون البحرية وفي إعداد مشاريع مواد اتفاقية بشأن حجز السفن.

113. ICS participated in and supported the work of the Joint Intergovernmental Group of Experts on Maritime Liens and Mortgages and Related Subjects (JIGE), both during the preparation of the draft which became the 1993 International Convention on Maritime Liens and Mortgages (1993 MLM Convention) and the recent sessions at which the draft articles for a Convention on the Arrest of Ships (Draft Articles) were prepared.
٣١١- شاركت الغرفة التجارية للنقل البحري في أعمال فريق الخبراء الحكومي الدولي المشترك المعني بالامتيازات والرهون البحرية والمواضيع المتصلة بها وأيدت عمله سواء أثناء إعداد المشروع الذي أصبح اتفاقية عام ٣٩٩١ الدولية المعنية بالامتيازات والرهون البحرية )اتفاقية الامتيازات والرهون البحرية لعام ٣٩٩١( أو بالدورات اﻷخيرة التي تم فيها إعداد مشاريع مواد اتفاقية بشأن حجز السفن )مشاريع المواد(.
