40 - واعتبرت وفود معيّنة البديل الثالث أنسب البدائل نظرا للجوانب الدقيقة والمعقدة للمسائل التي ينطوي عليها تنفيذ حكم ضد دولة ما، ولا سيما مسائل السياسة العامة التي من الممكن أن تكون قد أثرت على تصرف الدولة التي صدر حكم ضدها. ورأت تلك الوفود أنه من الأفضل أن تترك مسألة تنفيذ الحكم لممارسة الدولة.

359. As regards the so-called " triple alternative " , some members indicated that the surrender to an international criminal tribunal should not be dealt with in the present context, since it was submitted to different conditions, and posed different problems, from those arising from extradition.
