2.1 The complainant belongs to the Talysh minority group in Azerbaijan.

After his graduation in mechanical engineering in Russia and upon completion of his military service in Germany, he joined the Talysh separatist movement led by Alakram Hummanov, which strived to establish a Talysh republic.
وبعد حصوله على شهادة في اختصاص الهندسة الميكانيكية في روسيا وإنهاء خدمته العسكرية في ألمانيا، انضم إلى حركة التاليش الانفصالية التي يقودها الأكرم هومانوف، وهي حركة تناضل من أجل إنشاء جمهورية التاليش.

2.3 In 2001, the complainant was summoned by the police in several occasions and interrogated about the leader of the Talysh separatist movement, Hummatov.

The Board denied the existence of pronounced discrimination against the Talysh population in Azerbaijan and questioned the complainant's credibility as to how he had managed to escape from hospital and how his driver's licence had been issued.

Therefore, the human rights situation in Azerbaijan in itself does not suffice to conclude that the complainant's forced return would violate article 3.

The Government reports that Mr. Mammadov's participation in hostile activities included instructions and tasks aimed at initiating nationalist propaganda and raising awareness of the Talysh problem.

On 14 June 2006, Mr. Mammadov reportedly visited the Islamic Republic of Iran at the private invitation of Abdoli Ali Hamzali to attend a conference on Talysh culture in the city of Rasht.

Since 9 June 2012, he has been the editor-in-chief of the Baku-based newspaper Tolishi Sado (The Voice of Talysh), the only newspaper printed in the minority Talysh language.

The Government also reports that Mr. Mammadov gave biased and untrue interviews on a number of occasions about the difficult life of the Talysh people, violations of their human rights, and that they were facing assimilation as a result of a policy under consideration by the Republic of Azerbaijan.
