The foreign ministries of many small countries lacked the resources to verify the permissibility of every reservation of which they were notified, but a note from the depositary would serve the purpose of drawing attention to the possible need to take a position on the reservation in question.
وقيل إن وزارات الخارجية في كثير من البلدان الصغيرة لا تحوز الموارد اللازمة للتحقق مما إذا كان كل تحفظ تبلغ به تحفظ مسموح، وأن ورود مذكرة من الوديع ربما تؤدي هذه الغاية بتوجيه النظر إلى الحاجة المحتملة إلى اتخاذ موقف بشأن التحفظ المعني.

It does not mean that contracting States or international organizations are precluded from formally accepting the reservation in question if they so wish.
غير أنّ ذلك لا يمنع الدول والمنظمات الدولية المتعاقدة من قبول التحفظ المعني رسمياً متى أرادت .

The question remained, however, whether in some instances the acceptance by all contracting States of the reservation prohibited by the treaty could validate the reservation in question.
غير أنه يبقى ثمة سؤال حول ما إذا كان قبول جميع الدول المتعاقدة لتحفُّظ تحظره المعاهدة يلغي، في بعض الأحيان، صحة التحفظ المعني.

At least in cases brought under the Optional Protocol and where the reservation in question affects the applicability of the Protocol, the State is free to denounce the Protocol, as happened in the case of Trinidad and Tobago.

109. State practice shows that States often indicate in their objections not only that they consider the reservation in question contrary to the object and purpose of the Treaty but also, in more or less detail, how and why they reached that conclusion.
109 - ومن ناحية أخرى تدل ممارسات الدول على أنها كثيرا ما لا تقتصر في اعتراضاتها عن الإعراب عن رأيها بأن التحفظ المعني مناف لغرض المعاهدة ومقاصدها، بل توضح كذلك بشيء من التفصيل سبب وكيفية توصلها إلى ذلك الاستنتاج.

28. Where the reservation in question is one which has also been made by other States, the view of the body will put both those States and other contracting parties on notice that a similar view is likely to be taken of the reservations of the other States.
28- وإذا كان التحفظ المعني تحفظا أبدته أيضا دول أخرى، فإن رأي الهيئة سيشعر تلك الدول وغيرها من الدول المتعاقدة على حد سواء باحتمال صدور رأي مماثل بشأن تحفظات الدول الأخرى.

52. In relation to the argument of the Democratic Republic of the Congo that the reservation in question was without legal effect because, on the one hand, the prohibition on racial discrimination was a peremptory norm of general international law and, on the other, such a reservation was in conflict with a peremptory norm, the Court referred:
52 - " أما فيما يتعلق بحجة جمهورية الكونغو الديمقراطية القائلة بأن التحفظ المعني ليس له أثر قانوني لأن حظر التمييز العنصري يمثل قاعدة آمرة من قواعد القانون الدولي العام، من جهة، ولأن هذا التحفظ يتعارض مع قاعدة آمرة، من جهة أخرى " ، فإن المحكمة أحالت إلى:

(5) Moreover, State practice shows that States often indicate in their objections not only that they consider the reservation in question to be contrary to the object and purpose of the treaty but also, in more or less detail, how and why they reached that conclusion.

The latter are often formulated by reference to internal law in general or to whole sections of such law (such as the constitution, criminal law, family law) without any further detail, thus making it impossible to assess the compatibility of the reservation in question with the object and purpose of the treaty.
فالتحفظات الغامضة أو العامة كثيراً ما تُبدى بالإشارة إلى القانون الداخلي بشكل عام أو إلى أجزاء منه (من قبيل الدستور والقانون الجنائي وقانون الأسرة)() دون مزيد من التوضيح، الأمر الذي يحول دون تقدير توافق التحفظ المعني مع موضوع المعاهدة والغرض منها.

In its decision, the tribunal stated that whether the negative reaction of a State to a reservation amounted to a mere comment, a reservation of position, a rejection of the particular reservation or a rejection of any relations with the reserving State under the treaty depended on the intention of the State concerned.
وجاء في قرار المحكمة أن معرفة ما إذا كانت الدولة التي يكون رد فعلها سلبياً تقوم بمجرد التعليق على التحفظ أو تعرب عن موقفها في هذا الصدد أو ترفض التحفظ المعني أو كل صلة اتفاقية بالدولة المتحفِّظة في إطار المعاهدة، تتوقف بالتالي على نية الدولة المعنية.

67. The work done on reservations to treaties should uphold the principle that reservations must not prejudice the integrity and spirit of the instrument in question, and should make the State the ultimate judge of the admissibility of a given reservation.
67 - في العمل المتعلق بالتحفظات على المعاهدات ينبغي التمسك بمبدأ أن لا تمس التحفظات سلامة وروح الصك المعني، وينبغي جعل الدولة الحكم النهائي بشأن مقبولية التحفظ المعني.

(b) Prohibiting reservations to specified provisions and a reservation in question is formulated to one of such provisions; or
