40. The power of the Prosecutor to initiate investigations proprio motu was a controversial issue. In the first place, article 15 of the Statute stipulated that the Prosecutor could initiate investigations proprio motu on the basis of information on crimes within the jurisdiction of the Court.

٣٩ - وينبغي للمدعي العام ألا تكون له السلطة للشروع في التحقيقات من تلقاء نفسه ، حيث ان هذا قد يضعف بدلا من أن يعزز استقلاله بتعريضه الى ضغط سياسي والمناورة السياسية .

Mr. GEVORGIAN (Russian Federation) said that, if the Prosecutor was given direct power to initiate investigations, proprio motu, both the Prosecutor and the Court would become politicized.
٣٣١- السيد جيفورجيان )الاتحاد الروسي( : قال اذا أعطي المدعي العام سلطة مباشرة لبدء التحقيقات من تلقاء نفسه ، فان المدعي العام نفسه والمحكمة سوف يصبحان مسيﱠسين .

The provisions of article 6 (first version), paragraph 1 (c), and of articles 12 and 13 should therefore be retained.Mr. DABOR (Sierra Leone) said the Prosecutor should be empowered to initiate investigations proprio motu on the basis of information received from victims, intergovernmental organizations or non-governmental organizations.
وينبغي لذلك الابقاء على نصوص أحكام المادة ٦ )النسخة اﻷصلية( ، الفقرة ١ )ج( والمادتين ٢١ و ٣١ . ٦٣ - السيد دابور )سيراليون( : قال ان المدعي العام ينبغي أن يفوﱠض بسلطات لبدء التحقيقات من تلقاء نفسه على أساس المعلومات التي يتلقاها من المجني عليهم ومن المنظمات الدولية الحكومية أو غير الحكومية .

In regard to the latter, it favoured the following formulation for the first sentence: “The Prosecutor may initiate investigations proprio motu or on the basis of information obtained from any source, in particular from Governments, United Nations organs and intergovernmental and non-governmental organizations.” The second sentence would remain as drafted.
وفيما يتعلق بهذه المادة اﻷخيرة ، قال ان وفده يؤيد الصياغة التالية بالنسبة للجملة اﻷولى : " للمدعي العام أن يباشر التحقيقات من تلقاء نفسه على أساس معلومات مستقاة من أي مصدر ، وخاصة من الحكومات وأجهزة اﻷمم المتحدة والمنظمات الحكومية الدولية والمنظمات غير الحكومية " . وتظل الجملة الثانية بصيغتها الحالية .

Mr. ROWE (Australia) said that his delegation agreed that the Prosecutor should have the authority to initiate investigations proprio motu in accordance with the provisions of article 12, provided that his actions were subject to appropriate procedural safeguards such as those provided for in article 13, which proposed inter alia that the authorization of a pre-trial chamber should be obtained before an investigation could proceed.
٦١١- السيد روي )أستراليا( : قال ان وفده يوافق على أن تكون للمدعي العام سلطة بدء التحقيقات من تلقاء نفسه وفقا ﻷحكام المادة ٢١ ، شريطة أن تخضع اجراءاته الى ضمانات اجرائية مناسبة مثل تلك المنصوص عليها في المادة ٣١ ، والتي اقترحت ضمن أمور أخرى أنه لا بد من الحصول على اذن من الدائرة التمهيدية قبل امكان بدء التحقيق .
