He stressed that the right to be informed of progress in and the findings of an investigation was crucial and must not be worded in a way that would leave room for abuses or compromise the efficiency of the early warning machinery.

The State party is under the obligation to guarantee the right of the victims to know the truth on the circumstances of the enforced disappearance, the progress and results of the investigation and the fate of the disappeared person, as well as the right to obtain reparation and prompt, fair and adequate compensation.
ويقع على الدولة الطرف التزام بضمان حق الضحايا في معرفة الحقيقة عن ظروف الاختفاء القسري، وسير التحقيق ونتائجه ومصير الشخص المختفي، فضلاً عن الحق في الحصول على جبر للضرر وتعويض عاجل وعادل ومناسب.

It guarantees to any person with a legitimate interest the right to know the truth regarding the perpetrators and circumstances of the enforced disappearance, the progress and results of the investigation and the fate of the disappeared person, and establishes the obligation to set up an effective procedure for obtaining this information.
وتضمن لأي شخص يثبت أن لـه مصلحة مشروعة في معرفة الحقيقة عن مرتكبي الجريمة وعن ظروف الاختفاء القسري، وسير التحقيق ونتائجه ومصير الشخص المختفي، وتقضي بوضع إجراء فعال للحصول على هذه المعلومات.

وضمن مجموعة الحقوق المعترف بها، نشدد على حق الحصول على المعلومات عن الأشخاص المحرومين من الحرية وحق جميع الضحايا في معرفة الحقيقة فيما يتعلق بظروف الاختفاء القسري وتقدم التحقيق ونتائجه ومصير الشخص المختفي.

The resolution also makes explicit reference to the International Convention for the Protection of All Persons from Enforced Disappearance and its article 24, paragraph 2, which sets out the right of victims to know the truth regarding the circumstances of the enforced disappearance, the progress and results of the investigation and the fate of the disappeared person and State party obligations to take appropriate measures in this regard.
كما يشير القرار صراحة إلى الاتفاقية الدولية لحماية جميع الأشخاص من الاختفاء القسري والفقرة 2 من مادتها 24 التي تبين حق الضحايا في معرفة الحقيقة عن ظروف الاختفاء القسري، وسير التحقيق ونتائجه ومصير الشخص المختفي والتزامات الدولة الطرف باتخاذ التدابير الملائمة في هذا الصدد.

107. The Chairperson emphasized that States would still be able to withhold information when the interests of the investigation so required, and that the right to be informed of progress in and the findings of an investigation was not the same thing as a right of access to the case file.
