٤٧٣- كما أبلغت الحكومة الفريق العامل بأن الجمعية الوطنية التركية الكبرى اعتمدت مشروع قانون وارداً في مجموعة اصلاحات حقوق اﻹنسان لتركيا.

Turkey 1. On 21 November 1990, the Turkish Grand National Assembly adopted Law No. 3679 introducing important amendments to the Turkish Penal Code.
١- في ١٢ تشرين الثاني/نوفمبر ٠٩٩١، اعتمدت الجمعية الوطنية التركية الكبرى القانون رقم ٩٧٦٣ الذي أدخل تعديلات هامة على قانون العقوبات التركي.

Thus, in accordance with article 159/3 of the Turkish Penal Code, “those who vilify the laws of the Turkish Republic or the decisions of the Turkish Grand National Assembly shall be punished”.
وعليه فإن " مَن يحط من قوانين الجمهورية التركية أو قرارات الجمعية الوطنية التركية الكبرى يُعاقب " طبقاً للمادة ٩٥١/٣ من القانون الجنائي التركي.

46. The Constitutional Court examines the constitutionality, in respect of both form and substance, of laws, decrees having force of law and the rules of procedure of the Turkish Grand National Assembly.
46- وتنظر المحكمة الدستورية في دستورية القوانين والمراسيم التي لها قوة القانون وفي النظام الداخلي للجمعية الوطنية التركية الكبرى من حيث شكلها ومضمونها معاً.

72. The Commission submits an annual report as well as ad hoc reports it prepares concerning the discharge of its duties and issues within its mandate to the Presidency of the Turkish Grand National Assembly.
72- وتقدم اللجنة إلى رئاسة الجمعية الوطنية التركية الكبرى تقريراً سنويا وتقارير خاصة تعدها بشأن أدائها لواجباتها ومعالجتها للمسائل في حدود ولايتها.

In addition, it had revised its 2004 Constitution in order to give precedence to international conventions concerning fundamental rights and freedoms, including the rights of children, over national legislation. Lastly, Children's Rights Committees had been established in the 81 provinces of Turkey and a children's rights monitoring committee had been set up within the Turkish Grand National Assembly.
وقد نقحت أيضا دستورها لعام 2004 لإعطاء الأسبقية للاتفاقيات الدولية المتعلقة بالحقوق والحريات الأساسية، ومنها حقوق الطفل، على التشريعات الوطنية، وأخيرا أنشئت لجان لحقوق الطفل في المقاطعات التركية الـ 81، وأنشئت لجنة لرصد حقوق الطفل في الجمعية الوطنية التركية الكبرى.

30. Legislative authority is vested in the Turkish Grand National Assembly (TGNA).
30- تُخوَّل الجمعية الوطنية التركية الكبرى (الجمعية الوطنية) بالسلطة التشريعية.

The Turkish Penal Code (TPC) has been revised and updated within this context by the Turkish Grand National Assembly on 26 September 2004.
وتم تنقيح القانون الجنائي التركي واستكماله ضمن هذا السياق بواسطة الجمعية الوطنية التركية الكبرى في 26 أيلول/سبتمبر 2004.

On 14 December 2006, the Turkish Grand National Assembly adopted Law No. 5564 on the prohibition of the development, production, stockpiling and use of chemical weapons.
وفي 14 كانون الأول/ديسمبر 2006، اعتمدت الجمعية الوطنية التركية الكبرى القانون رقم 5564 بشأن حظر استحداث وإنتاج وتكديس واستخدام الأسلحة الكيميائية.

13. Since September 2010, the Turkish Grand National Assembly has ratified the following international agreements, which will enter into force upon the completion of internal ratification procedures:
13 - ومنذ أيلول/سبتمبر 2010، صدقت الجمعية الوطنية التركية الكبرى على الاتفاقات الدولية التالية، التي ستدخل حيز النفاذ عند انتهاء إجراءات التصديق الداخلية:

69. The Human Rights Inquiry Commission of the Turkish Grand National Assembly was established by Law No: 3686 on 5 December 1990 in order to protect and promote human rights in Turkey in accordance with contemporary universal values.
69- وقد أُنشئت لجنة التحقيق في مجال حقوق الإنسان التابعة للجمعية الوطنية التركية الكبرى بموجب القانون رقم 3686 المؤرخ في 5 كانون الأول/ديسمبر 1990، بغية حماية حقوق الإنسان وتعزيزها في تركيا وفقا للقيم العالمية المعاصرة.

94. Article 74 of the Constitution, entitled " Right of Petition " , states that " Citizens and foreigners resident considering the principle of reciprocity have the right to apply in writing to the competent authorities and to the Turkish Grand National Assembly with regard to the requests and complaints concerning themselves or the public " .
94- ووفقاً للمادة 74 من الدستور، تحت عنوان " حق رفع العرائض " ، " يكون للمواطن التركي والأجنبي المقيم، مع مراعاة مبدأ المعاملة بالمثل، الحق في أن يرفع طلباً مكتوباً إلى السلطات المختصة والجمعية الوطنية التركية الكبرى في شكل التماسات وشكاوى تخص شخصه أو الجمهور " .

5. According to the communication, Nurdan Baysahan, Elif Kahyaoglu, Deniz Kartal, Mahmut Yilmaz, Bulent Karakas, Ahmet Askin Dogan, Metin Murat Kalyoncugil and Ozgur Tufekçi, all students, were arrested on 1 May 1996 for having protested to the Turkish Grand National Assembly against the tuition fees for higher education establishments and against the policy of privatizing the universities.
٥- ووفقا للمصدر، أُلقي القبض في ١ أيار/مايو ٦٩٩١ على نوردان بايسهان، واليف كاهياوغلو، ودنيس كرتال، ومحمود يلمظ، وبولنت كراكاس، وأحمد أسكين دوغان، ومتين مراد كاليونشوغيل، وأوزغور توفكشي، وجيمعهم طلاب، لقيامهم بالاحتجاج لدى الجمعية الوطنية التركية الكبرى على رسوم التعليم في مؤسسات التعليم العالي وعلى سياسة خصخصة الجامعات.

As it may be recalled, on 27 February of this year I had the honour of informing the Conference on Disarmament that the Ottawa Convention had been resubmitted for accession to the Turkish Grand National Assembly by the new Government and that the Foreign Affairs Committee of the Turkish Parliament had endorsed the Convention and conveyed it to the General Assembly for final approval.
ولعله يجدر التذكير بأنني قد تشرفت في إحاطة مؤتمر نزع السلاح علماً، في 27 شباط/فبراير من هذه السنة، بأن الحكومة الجديدة عرضت مجدداً اتفاقية أوتاوا على الجمعية الوطنية التركية الكبرى لتوافق على الانضمام إليها، وأن لجنة الشؤون الخارجية التابعة للبرلمان التركي أيدت الاتفاقية وأحالتها إلى الجمعية العامة للحصول على موافقتها النهائية.
