C. The legal framework for the application of the provisions of the International Covenant on Civil and Political Rights in the light of the Libyan legislation in force
جيم - في اﻹطار القانوني لتطبيق أحكام العهد الدولي الخاص للحقـــوق المدنيــــة والسياسيـــة في ضوء التشريعات الليبية النافذة

Any provision contained in the International Covenant on Civil and Political Rights for which there is no corresponding provision in Libyan legislation is binding on the country's judiciary, as already mentioned.
كما سنرى من خلال الدراسة المقارنة ﻷحكامه مع التشريعات الليبية المذكورة، فإن أي حكم ورد في الاتفاقية، ولم يرد النص عليه في إحدى القوانين الليبية، يكون حكم، أو أحكام العهد الدولي الخاص بالحقوق المدنية والسياسية ملزم للقاضي الوطني كما ذكرنا.

261. We therefore find common ground between the provisions of Libyan legislation and those of article 17 in terms of their approach to the creation of an environment in which personal privacy and privacy of correspondence, the home and family affairs are guaranteed.
١٦٢- وهكذا: فإن نصوص التشريعات الليبية توجد أرضية مشتركة للتطبيق وعلاج الحالات التي تحرص على توفيرها المادة ٧١/١، ٢ كضمانات لحياة اﻷشخاص الخاصة ومراسلاتهم، وبيوتهم وشؤون أسرهم.

Libyan legislation paved the way for the provision of article 10 of the Convention concerning family reunification. The Convention therefore simply came to emphasize legislative procedures which were already in force in Libyan Arab society prior to adoption of the Convention.
158- وقد سبقت التشريعات الليبية ما نصت عليه المادة 10 بشأن جمع شمل الأسرة، بل إن الاتفاقية قد جاءت مؤكدة على إجراءات تشريعية معمول بها في المجتمع العربي الليبي حتى قبل صدور هذه الاتفاقية.

١٧٢ - وفيما يتعلق ﺑ " اﻹطار المحدود " المتصل بتعدد الزوجات، أوضح الممثل أن التشريعات الليبية تفضل الزواج بواحدة وأن تعدد الزوجات هو الاستثناء من القاعدة وهو في تناقص.

38. There are no provisions in Libyan legislation that discriminate on grounds of race, colour, sex, language, religion, opinion, national or social origin, property, birth or other status.
٨٣- ولم يرد في التشريعات الليبية أية أحكام تمييزية بسبب العرق، أو اللون، أو الجنس، أو اللغة، أو الدين، أو الرأي، أو اﻷصل القومي أو الاجتماعي، أو الثروة أو النسب أو غير ذلك من اﻷسباب.

Any suppression of human rights and freedoms that occurs, notwithstanding the legal, judicial and administrative safeguards provided under Libyan legislation for the protection of those rights and freedoms, is unequivocally regarded as an individual or administrative act incompatible with the attitudes and choices of society and is swiftly addressed by the judiciary in a deterrent manner.
وإذا ما حدث أي افتئات على حقوق الإنسان وحرياته رغم ما توفره التشريعات الليبية من ضمانات قانونية وقضائية وإدارية لحماية تلك الحقوق والحريات فإنه لا يعدو إلا أن يكون تصرفاً فردياً أو إدارياً لا يمت بصلة لتوجهات المجتمع وخياراته يتصدي له القضاء وبشكل عاجل ورادع.

(iii) The circumstances in which a foreigner may be expelled under Libyan law are set out exhaustively in the Act: if the foreigner entered the country without a visa, if he refuses to leave the country on the expiration of his entry visa or residence permit, or if a court of law orders his expulsion.
' ٣ ' ان ابعاد اﻷجنبي في حكم التشريعات الليبية أوردها القانون على سبيل الحصر، أو إذا دخل اﻷجنبي بدون تأشيرة، أو إذا امتنع عن مغادرة البلاد بالرغم من انتهاء تأشيرة الدخول، أو الاقامة، واذا صدر حكم قضائي بالابعاد.

220. It may therefore be concluded that the provisions of article 14, paragraph 1, of the Covenant are fully reflected in Libyan legislative enactments currently in force and in those that are still at the preparatory stage, such as the draft new Constitution.
٠٢٢- ولذلك فإن ما تقتضيه المادة ٤١، الفقرة ١ من أحكام العهد يجد استجابة كاملة في نصوص التشريعات الليبية السارية النفاذ، وفي تلك النصوص التي لا تزال في طور " اﻹعداد " كمشروع الدستور الجديد.
