To date the depositary country has received ratifications from three countries: France, Granada and Mexico; in addition, Cuba, Panama and Venezuela have informed the ACS secretariat that they have completed their domestic ratification procedures.

In this connection, the Committee cites General Assembly resolution 63/243, in which it strongly urged States parties to accelerate their domestic ratification procedures with regard to the amendment and to notify the Secretary-General expeditiously in writing of their agreement to the amendment.
وتشير اللجنة في هذا الصدد، إلى قرار الجمعية العامة 63/243 الذي حثت فيه بقوة الدول الأطراف على التعجيل باتخاذ إجراءات التصديق المحلية على التعديل وإخطار الأمين العام كتابةً وعلى وجه السرعة بموافقتها على التعديل.

In this connection, the Committee refers to General Assembly resolution 63/243 , in which the Assembly urged States parties to accelerate their domestic ratification procedures with regard to the amendment and to notify the Secretary-General expeditiously in writing of their agreement to the amendment.

In this regard, the Committee refers to General Assembly resolution 59/176 of 20 December 2004, in which the Assembly strongly urged States parties to accelerate their domestic ratification procedures with regard to the amendment, and to notify the SecretaryGeneral expeditiously in writing of their agreement to the amendment.

By virtue of draft article 18, the liability in the event that the foreign certificate was found to be defective was allocated to the domestic certification authority that provided such a guarantee.

واقترح أن تترك القواعد الموحدة للدولة المشترعة اتخاذ قرار بشأن ما ان كان بوسع سلطات التصديق المحلية ، وفي أية ظروف ، تقديم ذلك الضمان بشأن الشهادات التي تصدرها سلطات التصديق اﻷجنبية .

Support was expressed in favour of retaining in the Uniform Rules a provision that authorized a domestic certification authority to provide guarantees in connection with certificates issued by foreign certification authorities.
٤٩١ - وأعرب عن تأييد للابقاء في القواعد الموحدة على حكم يخول لسلطة التصديق المحلية تقديم ضمانات بصدد الشهادات التي تصدرها سلطات التصديق اﻷجنبية .

If the second interpretation was correct, paragraph (2) might place a foreign supplier of certification services that was not subject to mandatory licensing in its country of origin in equal standing with licensed domestic certification authorities, thus resulting in undesirable reverse discrimination against suppliers of certification services that needed to obtain a license in the enacting State.
واذا صح التفسير الثاني، فان الفقرة (2) قد تضع مورد خدمات التصديق الأجنبي الذي لم يخضع للترخيص الالزامي في بلده الأصلي على قدم المساواة مع سلطات التصديق المحلية المرخص لها، مما يؤدي الى تمييز عكسي غير مستصوب ضد موردي خدمات التصديق الذين يلزمهم الحصول على ترخيص في الدولة المشترعة.

In response to those views it was noted that, by allowing foreign entities to become established as certification authorities, draft article 17 merely stated the principle that foreign entities should not be discriminated against, provided that they met the standards set forth for domestic certification authorities.
٩٧١ - وردا على هذه اﻵراء أبديت ملاحظة مفادها أن مشروع المادة ٧١ ، بسماحه لﻷشخاص الاعتباريين اﻷجانب بأن يصبحوا مقيمين كسلطات تصديق ، انما ينص فحسب على المبدأ القائل بأنه ينبغي عدم التمييز ضد اﻷشخاص الاعتباريين اﻷجانب ، شريطة أن يفوا بالمعايير المقررة لسلطات التصديق المحلية .

With regard to draft article 18, it was noted that the purpose of the rule contained therein was merely to enable a domestic certification authority to guarantee, to the same extent as its own certificates, the correctness of the details of the foreign certificate, and to guarantee that the foreign certificate was valid and in force.
١٩١ - وبشأن مشروع المادة ٨١ ، لوحظ أن الغرض من القاعدة الواردة فيه هو مجرد تمكين سلطة التصديق المحلية من أن تضمن ، بنفس القدر الذي تضمن به شهاداتها هي ، صواب التفاصيل الواردة في الشهادة اﻷجنبية ، وأن تضمن أن الشهادة اﻷجنبية صحيحة ونافذة .
