3.1 The complainant claims that if he is returned to Iran he is at risk of being subjected to torture, and that his forcible removal to Iran would entail a violation of article 3 of the Convention by the State party.
3-1 يدعي الشاكي أنه يواجه خطر التعرّض للتعذيب في حالة إعادته إلى إيران وأن ترحيله قسريا إلى إيران سيشكل انتهاكا من قبل الدولة الطرف للمادة 3 من الاتفاقية.

The risk of being tortured in arrest or detention is overwhelming.
وإن خطر التعرّض للتعذيب أثناء التوقيف أو الاحتجاز وارد جداً.

7.6 In light of all the above, the Committee is not persuaded that the facts as submitted are sufficient to conclude that the complainant would face a foreseeable, real and personal risk of being subjected to torture if returned to Turkey.
7-6 وفي ضوء ما سبق، فإن اللجنة غير مقتنعة بأن الوقائع، على نحو ما عُرضت، كافية لاستنتاج أن صاحب الشكوى سيواجه خطر التعرّض للتعذيب بصورة شخصية وحقيقية ومتوقعة إذا أُعيد إلى تركيا.

8.9 In the circumstances, the Committee considers that substantial grounds exist for believing that the complainant may risk being subjected to torture if returned to Iran.
8-9 وفي ظل هذه الظروف، ترى اللجنة أنه توجد أسباب حقيقية تدعو إلى الاعتقاد بأن صاحب الشكوى قد يواجه خطر التعرّض للتعذيب إذا أُعيد إلى إيران.

It follows that the existence of a pattern of gross, flagrant or mass violations of human rights in a country does not as such constitute sufficient reason for determining that a particular person would be in danger of being subjected to torture on return to that country; additional grounds must be adduced to show that the individual concerned would be personally at risk.
وبالتالي فإن وجود نمط من الانتهاكات الجسيمة أو الصارخة أو الجماعية لحقوق الإنسان في بلد ما لا يشكل بذاته سبباً كافياً لتأكيد أن شخصاً بعينه سيواجه خطر التعرّض للتعذيب عند عودته إلى ذلك البلد؛ ويجب أن تكون هناك أسباب إضافية تبين أن الشخص المعني سيتعرض للتعذيب شخصياً.

4.6 It further notes that, under article 3 of the Convention, States parties are prohibited from expelling, returning or extraditing a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
4-6 وتلاحظ الدولة الطرف كذلك أن المادة 3 من الاتفاقية تنص على أنه لا يجوز للدول الأطراف أن تطرد أي شخص أو تُعيده أو تردّه إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرّض للتعذيب.

Until recently, this kind of progression had not occurred in respect of the criminal justice instruments with the exception that the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment was based substantially on the Declaration on the Protection of All Persons from being subjected to torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which was finalized at the Fifth Congress, in 1975.

(a) Article 21 of the draft Criminal Code should be amended to include the " danger of being subjected to torture " as one of the grounds for the refusal of extradition, as required by article 3 of the Convention;
