The wording used in the present draft decision was closely modelled on previous decisions on model laws, in particular the Model Law on Electronic Commerce and the Model Law on electronic signatures.
والصيغة المستخدمة في مشروع المقرر الحالي مقولبة على نحو وثيق على نسق مقررات سابقة بشأن قوانين نموذجية، وخصوصا القانون النموذجي بشأن التجارة الالكترونية والقانون النموذجي بشأن التواقيع الالكترونية.

“Variant A ‘digital signature’ means a type of an electronic signature consisting of a transformation of a data message using a message digest function and an asymmetric cryptosystem such that any person having the initial untransformed data message and the signer’s public key can accurately determine:

The remainder of the issues currently dealt with under the Uniform Rules might then be dealt with by way of a legal guide geared towards assisting parties with the structuring of their contracts regarding the issues of electronic signatures.
وعندئذ يمكن معالجة بقية المسائل المتناولة حاليا في اطار القواعد الموحدة بواسطة دليل قانوني يستهدف مساعدة اﻷطراف على هيكلة عقودها المتعلقة بمسائل التواقيع الالكترونية .

In addition, it was stated that the issue of attribution of digital signatures was important enough to be treated separately from the issue of attribution of other types of electronic signatures.
وقيل علاوة على ذلك إن مسألة اسناد التواقيع الرقمية مسألة لها من اﻷهمية ما يؤهلها ﻷن تعالج منفصلة عن مسألة اسناد اﻷنواع اﻷخرى من التواقيع الالكترونية .

Another view was that the rules established under draft article 3 should apply both to digital signatures and to other electronic signatures.
وذهب رأي آخر الى أن القواعد المقررة في اطار مشروع المادة ٣ ينبغي أن تنطبق على التواقيع الرقمية وعلى غيرها من التواقيع الالكترونية .

The prevailing view was that, to the extent possible, the issues addressed under draft article 3 should be dealt with in a media-neutral manner to cover a broad range of electronic signatures.
وكان الرأي السائد هو أن المسائل المتناولة في اطار مشروع المادة ٣ ينبغي ، بقدر الامكان ، تناولها بطريقة محايدة فيما بين الوسائط ، بغية تغطية نطاق واسع من التواقيع الالكترونية .

In support of Variant B, it was said that it appropriately focused on digital signatures which, by contrast to other types of electronic signatures, were sufficiently known and widely used.
وقيل تأييدا للبديل باء إنه يركز التركيز الصحيح على التواقيع الرقمية ، التي هي ، مقارنة باﻷنواع اﻷخرى من التواقيع الالكترونية ، معروفة معرفة كافية ومستخدمة على نطاق واسع .

The Working Group also discussed the issues of digital signatures, other electronic signatures, certification authorities and related legal issues on the basis of the note prepared by the Secretariat (A/CN.9/WG.IV/WP. 73).
٣١ - كما ناقش الفريق العامل المسائل المتعلقة بالتواقيع الرقمية وغيرها من التواقيع الالكترونية وسلطات التصديق والمسائل القانونية ذات الصلة على أساس المذكرة التي أعدتها اﻷمانة (A/CN.9/WG.IV/WP.73) .

It was emphasized that issues of attribution of data messages to their originator, integrity of data messages and accountability of parties involved in electronic commerce should be at the core of the efforts of the Working Group on digital and other electronic signatures.
وجرى التأكيد على أن اسناد رسائل البيانات الى مصدريها ، وسلامة رسائل البيانات ، ومسؤولية اﻷطراف المشتركة في التجارة الالكترونية ينبغي أن تكون في صلب جهود الفريق العامل المتعلقة بالتواقيع الرقمية وغيرها من التواقيع الالكترونية .

56. Mr. Boulet (Belgium) said that the UNCITRAL Model Law on electronic signatures had laid down explicit criteria for determining what constituted a reliable method.
56- السيد بوليه (بلجيكا): قال إن قانون الأونسيترال النموذجي بشأن التواقيع الالكترونية قد وضع معايير صريحة لتحديد طبيعة الطريقة الموثوقة.

Differing views were expressed as to whether the draft article should deal only with the attribution of secure electronic signatures (or digital signatures) or whether it should also address the issue of liability of the purported signer to the relying parties.
١٥ - وأعرب عن آراء متباينة بشان ما اذا كان ينبغي ألا يتناول مشروع المادة سوى اسناد التواقيع الالكترونية المأمونة )أو التواقيع الرقمية( أم ينبغي أن يتناول أيضا قضية مسؤولية الشخص المشار الى أنه صاحب التوقيع تجاه اﻷطراف المعتمدة على التوقيع .

In order to address the concerns expressed with regard to draft article 3 and onthe assumption that the issue of attribution of secure electronic signatures was sufficiently addressed in draft article 2 of the Uniform Rules, the suggestion was made that the focus of draft article 3 should be shifted to the issue of liability of the purported signer and, thus, article 3 should read along the following lines:
٨٥ - من أجل التصدي للشواغل التي أعرب عنها حول مشروع المادة ٣ ، وبافتراض أن مسألة اسناد التواقيع الالكترونية المأمونة عولجت معالجة كافية في مشروع المادة ٢ من القواعد الموحدة ، قدم اقتراح مفاده أن تركيز مشروع المادة ٣ ينبغي أن يحول الى مسألة مسؤولية الشخص المشار الى أنه صاحب التوقيع ، وعليه ينبغي أن يكون نص المادة ٣ على غرار ما يلي :

Pending a final decision as to the form of the Uniform Rules, the suggestion to prepare a convention at a later stage should not distract the Working Group from its current task, which was to focus on the preparation of draft uniform rules on digital and other electronic signatures, and from its current working assumption that the Uniform Rules would be in the form of draft legislative provisions.
وبانتظار اتخاذ قرار نهائي حول شكل القواعد الموحدة ، ينبغي ألا يؤدي اقتراح اعداد اتفاقية في مرحلة لاحقة الى صرف انتباه الفريق العامل عن مهمته الحالية ، وهي التركيز على اعداد مشروع قواعد موحدة بشأن التواقيع الرقمية وغيرها من التواقيع الالكترونية ، وعن الافتراض العملي الحالي بأن القواعد الموحدة ستكون على شكل مشروع أحكام تشريعية .

The Working Group had before it the following documents: provisional agenda (A/CN.9/WG.IV/WP.81); a note by the Secretariat containing revised draft uniform rules on electronic signatures (A/CN.9/WG.IV/WP.82).
٦١ - وكان معروضا على الفريق العامل الوثيقتـان التاليتـان : جـدول اﻷعمـال المؤقـت (A/CN.9/WG.IV/WP.81) ؛ ومذكرة من اﻷمانة تحتوي على مشروع منقح لقواعد موحدة بشأن التواقيع الالكترونية (A/CN.9/WG.IV/WP.82) .

It was noted, at the outset, that the scope of draft article 12 should be understood as covering the activities of information certifiers only in connection with those electronic signature that were intended to produce legal effect under draft articles 6 and 7.
٤٢١ - ذكر في البدء أن نطاق مشروع المادة ٢١ ينبغي أن يفهم على أنه يشمل أنشطة جهات التصديق على المعلومات فيما يتعلق فحسب بتلك التواقيع الالكترونية التي يقصد بها أن تستحدث مفعولا قانونيا بمقتضى مشروعي المادتين ٦ و ٧ .

“(2) With respect to a data message authenticated by means of an electronic signature other than a secure electronic signature, nothing in these Rules affects existing legal or evidentiary rules regarding the burden of proving the authenticity and integrity of a data message or an electronic signature.
" )٢( بخصوص رسالة بيانات موثقة بواسطة توقيع الكتروني غير التواقيع الالكترونية المأمونة ، لا تنطوي هذه القواعد على أي شيء يمس بما هو موجود حاليا من القواعد القانونية أو الاثباتية المتعلقة بعبء اثبات موثوقية وسلامة رسالة البيانات أو التوقيع الالكتروني .
