457. It is suggested that the Government consider undertaking further measures with respect to the implementation of article 4 (b) of the Convention which requires States parties to declare illegal and prohibit organizations which promote and incite racial discrimination.
٧٥٤ - ويقترح أن تنظر الحكومة في أمر اتخاذ المزيد من التدابير فيما يتعلق بتنفيذ المادة ٤ )ب( من الاتفاقية التي تقتضي قيام الدول اﻷطراف بإعلان عدم شرعية المنظمات التي تقوم بالترويج للتمييز العنصري والتحريض عليه وحظر تلك المنظمات.

In this regard, it is noted that such an interpretation is in conflict with the State party's obligations under article 4 (b) of the Convention to prohibit organizations which promote and incite racial discrimination and to declare the participation therein an offence and is not in accord with the Committee's General Recommendation XV (42).
وفي هـذا الصـدد، لوحظ أن ذلك التفسير يتعارض مع التزامات الدولة الطرف بموجب الفقرة ٤ )ب( من الاتفاقية التي تحظر المنظمات التي تقوم بالترويج للتمييز العنصري والتحريض عليه وتعتبر الاشتراك في أيهما جريمة، وأنه تفسير لا يتوافق مع التوصية العامة ١٥ للجنة )د - ٤٢(.

227. The Committee recommends that the Belgian Government take the necessary legal steps to implement article 4 (b) of the Convention, according to which States parties shall declare illegal and prohibit organizations " which promote and incite racial discrimination " .
٧٢٢ - وتوصي اللجنة أيضا بأن تتخذ الحكومة البلجيكية الخطوات القانونية اللازمة لتنفيذ المادة ٤ )ب( من الاتفاقية، التي تقضي بأن تعلن الدول اﻷطراف عدم شرعية المنظمات " التي تقوم بالترويج للتمييز العنصري والتحريض عليه " .

States parties have also undertaken to punish by law the dissemination of ideas based on racial superiority or hatred and to prohibit organizations which promote and incite racial discrimination (art. 4, paras. (a) and (b)).
كما تعهدت الدول الأطراف بأن تعاقب بموجب القانون نشر الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية، وأن تحظر المنظمات التي تقوم بالترويج للتمييز العنصري والتحريض عليه (الفقرتان (أ) و(ب) من المادة 4).

Moreover, it is noted that the State party's legislation does not fully comply with article 4 (b) of the Convention, which requires that " organizations, and also organized and all other propaganda activities, which promote and incite racial discrimination " be declared illegal and that " the participation in such organizations " be declared an offence punishable by law.
ولوحظ أيضا أن تشريعات الدولة الطرف لا تمتثل تماما للمادة ٤ )ب( من الاتفاقية التي تنص على إعلان عدم شرعية " المنظمات وكذلك النشاطات الدعائية المنظمة وسائر النشاطات الدعائية اﻷخرى التي تقوم بالترويج للتمييز العنصري والتحريض عليه " وعلى حظر " الاشتراك في هذه المنظمات " واعتباره جريمة يعاقب عليها القانون.
