2. In investor-State arbitrations initiated under the UNCITRAL Arbitration Rules pursuant to a treaty concluded before 1 April 2014, these Rules shall apply only when:
2- في عمليات التحكيم بين المستثمرين والدول التي تُستهل بمقتضى قواعد الأونسيترال للتحكيم عملاً بمعاهدة مبرمة قبل 1 نيسان/أبريل 2014، لا تنطبق هذه القواعد إلاَّ في الحالتين التاليتين:

" (_) The UNCITRAL Rules on Transparency shall apply to investor-State dispute settlement initiated [under the UNCITRAL Arbitration Rules] on the basis of the [name of the investment treaty]. "
" (ــ) تُطبَّق قواعد الأونسيترال بشأن الشفافية على عملية تسوية المنازعات بين المستثمرين والدول التي تُستهل [بموجب قواعد الأونسيترال للتحكيم] بالاستناد إلى [يُدرج اسم المعاهدة الاستثمارية]. "

" (_) The UNCITRAL Rules on Transparency shall apply to arbitrations initiated under [provision on dispute settlement between an investor and the host State] of the [name of the investment treaty]. "
" (ــ) تُطبَّق قواعد الأونسيترال بشأن الشفافية على إجراءات التحكيم التي تُستهل بموجب [الحكم بشأن تسوية المنازعات بين المستثمر والدولة المضيفة] من [يُدرج اسم المعاهدة الاستثمارية]. "

1. Article 1(2): The United States of America recommends deletion of the bracketed language " or (ii) treaty-based investor-State arbitrations initiated under other arbitration rules or ad hoc. "
1- المادة 1 (2): توصي الولايات المتحدة الأمريكية بحذف الصيغة الواردة بين معقوفتين " أو `2` في عمليات التحكيم التعاهدي بين المستثمرين والدول التي تُستهل بمقتضى قواعد تحكيم أخرى أو قواعد مخصصة. "

" (1) The Rules on Transparency shall apply to investor-State arbitrations initiated under the UNCITRAL Arbitration Rules pursuant to a treaty providing for the protection of investments or investors (`treaty') concluded after [date of coming into effect of the Rules on Transparency], unless the Parties to the treaty have agreed otherwise.

2. We recommend that the words in brackets " [or (ii) in treaty-based investor-State arbitrations initiated under other arbitration rules or ad hoc] " be added in the chapeau of paragraph (2).
2- نوصي بأن تضاف إلى فاتحة الفقرة (2) العبارة التالية الواردة بين معقوفتين " [أو `2` في عمليات التحكيم التعاهدي بين المستثمرين والدول التي تُستهل بمقتضى قواعد تحكيم أخرى أو قواعد مخصصة] " .
