وقد شرح لاحقاً مفهوم أشد الجرائم خطورة وذلك في الضمانات التي تكفل حماية حقوق أولئك الذين يواجهون عقوبة اﻹعدام، ووفقاً لها فإن أشد الجرائم خطورة هي " الجرائم المتعمدة التي تسفر عن نتائج مميتة أو نتائج أخرى بالغة الخطورة " .
