ويكون ﻷي دولة عضو في اﻷمم المتحدة تكون طرفا في الاتفاقية المتعلقة بمسؤولية الدول وتدعي أن جناية قد ارتكبت أو يجري ارتكابها الحق في عرض القضية على الجمعية العامة أو على مجلس اﻷمن.

لا يتخذ أي مجلس أو لجنة أو هيئة مختصة أخرى أي قرار ينطوي على تغيير في الميزانية البرنامجية التي وافقت عليها الجمعية العامة أو على احتمال تطلُّب نفقات ما لم تكن قد تلقت تقريرا من الأمين العام عن الآثار المترتبة في الميزانية البرنامجية على هذا الاقتراح وأخذته في اعتبارها.
