In particular, the Committee is concerned that children born in Tunisia automatically acquire Tunisian nationality through male ascendants, but not through female ascendants.

119. The Tunisian nationality Code, article 6, provides that the following persons shall have Tunisian nationality:

8. In granting Tunisian nationality to foreigners married to Tunisians, Tunisian law currently discriminated in favour of women.

A foreign woman married to a Tunisian man could apply for Tunisian nationality after two years' residence in the country, whereas a foreign man married to a Tunisian woman could do so only after five years' residence.
فالمرأة اﻷجنبية التي تتزوج تونسياً يمكنها أن تقدم طلباً للحصول على الجنسية التونسية بعد عامين من اقامتها في البلد، في حين أن الرجل اﻷجنبي المتزوج من تونسية لا يمكنه أن يفعل ذلك إلا بعد إقامته في البلد مدة خمس سنوات.

110. Pursuant to law no. 55/2010 (1 December 2010), amending certain provisions of the Tunisian nationality Act, Tunisia lifted all forms of discrimination between mother and father in respect of granting Tunisian nationality to children, thus enabling a Tunisian mother to pass on her nationality to her children, the same as a father.
110- رفعت تونس بمقتضى القانون عدد 55 لسنة 2010 المؤرخ في 1 كانون الأول/ ديسمبر 2010 والمتعلق بتنقيح بعض أحكام مجلة الجنسية التونسية، كل أشكال التمييز بين الأم والأب في مجال منح الجنسية التونسية للأبناء مما مكن الأم التونسية من إسناد جنسيتها لأبنائها، شأنها في ذلك شأن الأب.

21. Please indicate whether the State party envisages repealing the remaining provisions discriminating against women pertaining to the acquisition of Tunisian nationality.
21- يرجى بيان ما إذا كانت الدولة الطرف تتوخى إلغاء الأحكام المتبقية التي تميز ضد المرأة فيما يتعلق بالحصول على الجنسية التونسية.

Law No. 55 of 2010 had amended provisions of the Tunisian nationality Code to allow Tunisian women married to a foreigner to pass their nationality to their children in the same way as men.
وعدّل القانون رقم 55 لعام 2010 أحكام مجلة (قانون) الجنسية التونسية لتمكين التونسيات المتزوجات من أجانب من منح جنسيتهن إلى أطفالهن على غرار الرجال.

The Committee notes with interest the information provided by the delegation about the draft law amending article 6 of the Nationality Code. It remains concerned, however, that the Nationality Code does not provide women with the same rights as men to acquire or transmit their Tunisian nationality.
58- تحيط اللجنة علماً مع الاهتمام بالمعلومات التي قدمها الوفد حول مشروع قانون تعديل الفصل 6 من مجلة الجنسية التونسية، غير أنها تظل قلقة لأن قانون الجنسية لا يمنح المرأة نفس الحقوق التي يتمتع بها الرجل في الحصول على الجنسية التونسية أو نقلها إلى ذريتها.

As to the questions relating to the nationality of children, the revised Nationality Code (ibid., para. 76 (h)), contained provisions whereby a child born outside Tunisia of a Tunisian mother married to a foreigner was entitled to Tunisian nationality on application; any such child born on Tunisian territory automatically acquired Tunisian nationality.
٥- وبخصوص اﻷسئلة المتعلقة بجنسية اﻷطفال، قال إن مجلة الجنسية المنقحة )المرجع نفسه، الفقرة ٦٧ )ح((، تضمنت أحكاماً يحق بموجبها للطفل الذي يولد خارج تونس ﻷم تونسية وأب أجنبي الحصول على الجنسية التونسية شرط المطالبة بها، كما أن أي طفل من أم تونسية وأب أجنبي يولد على اﻷراضي التونسية يحصل تلقائياً على الجنسية التونسية.
