2.1.1.5. Law No. 6 of 1990 concerning Yemeni nationality

Article 3 of the Yemeni nationality Act No. 6 of 1990 also provides as follows: " Yemeni nationality shall be enjoyed by:

93. Article 4 sets out the cases in which Yemeni nationality is granted by republican decree after consultation with the Minister.

Article 3 of the Yemeni nationality Act guarantees some of the rights of the child by preserving the child's identity in the following cases:
تضمﱠن قانون الجنسية اليمنية حقوقاً للطفل من خلال تأمين الحفاظ على الهوية طبقاً لما جاء في المادة ٣ وذلك في الحالات اﻵتية:

The purpose of these provisions is to ensure that women with Yemeni nationality can enjoy equal rights with their husbands and enable them to enjoy a stable married life.
وذلك بالقدر الذي يساعد الزوجة التي تحمل الجنسية اليمنية على إقامة حياة متوازنة في الحقوق مع زوجها ويكفل لهما حياة زوجية مستقرة.

Yemeni legislation granted Yemeni nationality to the children of Yemeni mothers, even if the father was not a Yemeni or was stateless.
والمفترض أن تكون الفتيات غير المتزوجات عذارى ويمنح التشريع اليمني الجنسية اليمنية إلى أطفال الأمهات اليمنيات حتى لو كان الأب غير يمني أو كان عديم الجنسية.

On the question of entitlement to Yemeni nationality, he would welcome information on whether sexual equality was maintained in the application of the provisions of article 3 of the Yemeni nationality Act of 1990.
٤٠ - وفيما يتعلق بمسألة أهلية الحصول على الجنسية اليمنية ذكر أنه يرحب بتلقي أي معلومات تتعلق بالمساواة بين الجنسين عند تطبيق أحكام المادة ٣ من قانون الجنسية اليمنية لعام ١٩٩٠.

6. Under article 3, paragraph 1, of the Nationality Law, Yemeni nationality was conferred on persons born to fathers who were citizens of Yemen.

Her second question concerned women's rights and the requirement that a woman must be of good moral standing in order to be eligible for Yemeni nationality.

In a significant move, however, the Council of Ministers recently approved the proposed amendment to the Nationality Act with the addition of a new article, pursuant to which the children of a Yemeni woman married to a non-national are, in the event of her divorce, accorded the full rights enjoyed by children whose parents are both Yemeni and may be granted Yemeni nationality after they attain 18 years of age, if they so choose;
إلا أنه، في خطوة مهمة، أقر مؤخراً مجلس الوزراء التعديلات المقترحة في قانون الجنسية وذلك بإضافة مادة جديدة تعطي لأطفال المرأة اليمنية المتزوجة من أجنبي في حالة طلاقها كافة الحقوق التي يتمتع بها الأطفال من أبوين يمنيين ومنحهم الجنسية اليمنية بعد بلوغهم الثامنة عشرة إن اختاروا ذلك؛

No Yemeni may be deprived of his or her nationality. Once Yemeni nationality is acquired, it may not be withdrawn save by due process of law (art. 44).
(ينظم القانون الجنسية اليمنية ولا يجوز إسقاطها عن يمني إطلاقاً، ولا يجوز سحبها ممن أكتسبها إلا وفقاً للقانون).

An expatriate who possessed Yemeni nationality at the time of his departure from the territory of the country and has not renounced such citizenship under the law, based on an such person's explicit request, even if the person has acquired the nationality of the country where he resides by force of its laws " .
٣ - من كان يحمل الجنسية اليمنية من المغتربين حين مغادرته أراضي الوطن ولم يتخلَ عن هذه الجنسية وفقا للقانون وبناء على طلب صريح منه ولو اكتسب جنسية البلاد التي يقطنها بمفروض قوانينها.

42. JS5 observed that Law 25 in 2010 granted Yemeni nationality automatically to any child of a Yemeni mother or father married to a foreigner.
