A specific example cited was the case of " establishment " requirements, which required suppliers and contractors to establish a business entity in the State of the procuring entity or to hold assets there.

(d) If the supplier or contractor claims to be adversely affected by a decision of the head of the procuring entity (or of the approving authority) under article 53, provided that the complaint is submitted within 20 days after the issuance of the decision.
)د( إذا ادعى المورد أو المقاول تضرره من قرار أصدره رئيس الجهة المشترية )أو رئيس جهة إصدار الموافقة( بموجب المادة ٥٣، بشرط أن تقدم الشكوى في غضون ٢٠ يوما من وقت اصدار القرار.

(e) Revise an unlawful decision by the procuring entity or substitute its own decision for such a decision, other than any decision bringing the procurement contract into force;

هي الإجراءات التي يستهلّها المورِّد أو المقاول المتظلِّم لدى الجهة المشترية أو لدى هيئة مستقلة أو محكمة ضد قرار أو تدبير اتَّخذته الجهة المشترية، وأيّ اعتراض أو استئناف يُقدَّم لاحقاً إلى هيئة مختصّة في الدولة ضد أيِّ قرار يُتَّخذ في إجراءات الاعتراض.
