With regard to violations of press freedoms, he said that any curtailment of journalists' freedom was for reasons unrelated to their profession.

297. The violations of press freedoms in the Gaza Strip that have come to the attention of the Commission include the following.
297 - ومن الانتهاكات التي وقفت عليها اللجنة بشأن الحريات الصحفية في قطاع غزة:

262. The Palestinian Press and Publications Law (No. 9 of 1995) deals with press freedoms in more than one passage; article 2 of the Law provides:
262 - وتناول قانون المطبوعات والنشر الفلسطيني رقم (9) للعام 1995 الحريات الصحفية في أكثر من موضع، حيث نصت المادة (2) من القانون على ما يلي:

274. All the reports of the organizations concerned with monitoring and documenting press freedoms and the exercise by Palestinians of the freedom of opinion and expression, in addition to the statements issued and contributions submitted by those organizations, indicated that press freedoms in the West Bank were the object of a number of violations, the most important of them being the following:
274 - وأشارت جميع تقارير المؤسسات المعنية برصد وتوثيق الحريات الصحفية وممارسة الفلسطينيين لحرية الرأي والتعبير، فضلا عن البيانات والمداخلات التي أصدرتها ورفعتها هذه المؤسسات، إلى تعرض الحريات الصحفية في الضفة الغربية إلى عدة انتهاكات أهمها:

447. The Cairo Institute for Human Rights Studies endorsed the pledges to reform the 1980 Law on Publications and all other related laws in the country, calling upon the United Arab Emirates to lift the governmental control over press freedoms and to limit legal restrictions on the right to freedom of expression, including the right to political dissent and the right to receive information.
447- وأيد مركز القاهرة لدراسات حقوق الإنسان الالتزامات بتعديل قانون عام 1980 بشأن النشر والقوانين الأخرى ذات الصلة في البلد، مطالبا الإمارات العربية المتحدة برفع جميع إجراءات الرقابة الحكومية على الحريات الصحفية والحد من القيود القانونية المفروضة على الحق في حرية التعبير، بما في ذلك الحق في الاختلاف السياسي والحق في الحصول على معلومات.

The Commission will exercise its mandate to investigate violations in numerous fields that were committed by Palestinian bodies in the West Bank, including arrest and torture, violation of the freedom to form associations, the targeting of non-governmental organisations (NGOs) and obstruction of their work, failure to implement court rulings relating to NGOs and violation of press freedoms and the right to peaceful assembly.
حيث ستمارس اللجنة ولايتها في التحقيق بالانتهاكات المرتكبة من الجهات الفلسطينية في الضفة الغربية بالعديد من الجوانب ومنها (الاعتقال والتعذيب، وانتهاك حرية تكوين الجمعيات، واستهداف وعدم تمكين المنظمات الأهلية من ممارسة عملها، وعدم تنفيذ قرارات المحاكم المتعلقة بهذه الجمعيات، وانتهاك الحريات الصحفية وحق التجمع السلمي).

The Printing and Publishing Act, which was amended by Act No. 27 of 2007, guarantees press freedoms: no journalist can be imprisoned for a story that he or she has had published. The penalty of imprisonment is no longer included in the Act; any breaches of the law carry a fine instead. The Act does not specify the amount of capital required to start a newspaper, and it safeguards the confidentiality of journalists' sources.
- وقد كفل قانون المطبوعات والنشر الذي عدل بالقانون رقم (27) لعام 2007 الحريات الصحفية المتمثلة بعدم توقيف الصحفي في إطار أي قضية تتعلق بالمطبوعات، حيث اصبح القانون خالي من عقوبة الحبس، وجعل العقوبة على مثل هذه المخالفات غرامات مالية وعدم تحديد رأس المال لتأسيس الصحف، والمحافظة على سرية المصادر الصحفية .
