In article 28, States parties recognize the right of persons with disabilities to social protection and to the enjoyment of that right without discrimination on the basis of disability.

Article 5 of the International Convention on the Elimination of All Forms of Racial Discrimination also guarantees this right without distinction as to race, colour, or national or ethnic origin (art. 5 (e)), and the Committee on the Elimination of Racial Discrimination affirmed that discrimination on the basis of citizenship is prohibited.
