27- وكثير من الخادمات المنزليات المهاجرات يقعن ضحايا لاعتداءات جنسية من جانب مستخدِميهن أو أبنائهم أو أقربائهم أو من جانب خدم منزليين آخرين يعيشون في البيت(9).

The exploitative working conditions and psychological violence, the control and domination of migrant domestic workers by their employers, and restrictions on their freedom of movement increase the workers' sense of isolation and powerlessness to such an extent that they are often afraid to leave their jobs.
إن أوضاع العمل التعسفية والعنف النفسي والتسلط والسيطرة على الخادمات المنزليات المهاجرات من قبل مستخدِميهم، والقيود المفروضة على حرية حركتهن، تزيد من شعورهن بالعزلة والعجز إلى درجة أنه كثيراً ما ينتابهن الخوف من ترك عملهن.

51. One of the factors contributing to the vulnerability of migrant domestic workers, to their trafficking and to violations of their human rights is the absence of a written contract of employment.
51- إن أحد العناصر التي تسهم في إمكانية تعرُّض الخادمات المنزليات المهاجرات للاتجار بهن ولانتهاك حقوقهن الأساسية هو عدم وجود عقد عمل مكتوب.

The embassy of the Philippines covers legal costs if the case is taken to court; the embassy of India has funds available to repatriate female migrant domestic workers who wish to escape from a situation of abuse or have had disputes with their employers.
وتتحمل سفارة الفلبين تكاليف الدعاوى عندما تحال القضايا إلى المحاكم؛ ولدى سفارة الهند مخصصات تعاد بها إلى البلد الخادمات المنزليات المهاجرات الراغبات في التخلص من حالات تعسفية أو اللواتي توجد منازعات بينهن وبين مستخدميهن.

When migrant domestic workers cannot claim their rights in court, the Special Rapporteur considers it good practice for consulates to help mediate between the parties through contacts with the ministries and departments concerned.
وعندما يتعذر على الخادمات المنزليات المهاجرات أن يطالبن بحقوقهن أمام المحاكم، ترى المقررة الخاصة أن قيام القنصليات بالوساطة بين الأطراف بإقامة اتصالات مع الوزارات والإدارات المعنية هي مبادرة في عداد الممارسات الجيدة.

With regard to the execution of a foreign national in Saudi Arabia, the Special Rapporteur on the human rights of migrants stated that " given the large number of women migrant domestic workers in Saudi Arabia it is of paramount importance that transparent laws are put in place to ensure that all procedural rights and guarantees are afforded to all persons in Saudi Arabia, no matter their migration status or nationality. "
