وبناء عليه، فإلى حين صدور قرار من الجمعية العامة بشأن شروط الخدمة المطبقة على قضاة محكمة رواندا، تنطبق المرتبات السنوية وغيرها من شروط الخدمة التي أوصت بها اللجنة الاستشارية لشؤون اﻹدارة والميزانية للمحكمة الجنائية الدولية ليوغوسلافيا السابقة على قضاة الموضوع في المحكمة الجنائية الدولية لرواندا.

For those reasons, in paragraph 20 of his report, the Secretary-General states that, since the conditions of service applicable to the judges of the Tribunals are set and approved by the General Assembly, the Assembly may wish to decide to extend the pension scheme of the permanent judges of the International Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda to the ad litem judges.

On the occasion of the periodic review undertaken in 2001, the President of ICTR recalled that the Statute of ICTR provides in article 12, paragraph 5, that the terms and conditions of service for the judges of ICTR shall be those of the judges of ICTY. This is a general principle that does not exclude that there is a difference between duty stations of the judges of these two Tribunals.
