This exemption represents an immunity which the sending State is recognized as possessing in respect of acts which are those of a sovereign State.

Article 36, paragraph 1, subparagraph (a), guarantees the freedom of communication between consular officers and nationals of the sending State.

Because of the costs involved in posting a liaison officer to another State, liaison officers tend to be sent only to those States with which the sending State has already had a considerable amount of cooperation.

Article 36, paragraph 1 (a) guarantees the freedom of communication between consular officers and nationals of the sending State.

" 1. With a view to facilitating the exercise of consular functions relating to nationals of the sending State:

They shall also have the right to visit any national of the sending State who is in prison, custody or detention in their district in pursuance of a judgment.
وفي التحدث والتراسل معه وفي ترتيب من يمثله، ولهم أيضا الحق في زيارة أي من رعايا الدولة الموفدة يكون مسجونا أو معتقلا أو محتجزا في دائرة اختصاصهم بموجب حكم.

While it was true that recognition or non-recognition of the sending State would affect the legal status of foreign State officials in criminal proceedings, his delegation was not in favour of including in the draft specific provisions on that subject; a " without prejudice " clause would suffice.
فرغم أنه من الصحيح أن اعتراف الدولة الموفدة أو عدم اعترافها يؤثر على المركز القانوني لمسؤولي الدولة الأجنبية في الإجراءات الجنائية، فإن وفد بلده لا يؤيد إدراج مشاريع أحكام محددة في ذلك الموضوع؛ إذ يكفي استخدام عبارة ' ' دون الإخلال``.

" a. consular officers shall be free to communicate with nationals of the sending State and to have access to them.

" c. consular officers shall have the right to visit a national of the sending State who is in prison, custody or detention, to converse and correspond with him and to arrange for his legal representation.
