وأبلغت دول أخرى أيضا بأنها اعتمدت سياسات تقضي بعدم تسليم أي أشخاص إلى دول أخرى لجرائم تعاقب عليها تلك الدول بالإعدام ما لم تؤكّد لها الدولة صاحبة الطلب أنها لن تنفّذ مثل هذه العقوبة، أو بأن قانونها ينص على عدم جواز تسليم أي أشخاص إلى دولة أخرى لجرائم تعاقب عليها الدولة صاحبة الطلب بالإعدام.

(g) The Chair of the Committee acknowledging such offers and sending a letter to the requesting State informing it of such offers.

One instance where the United States may not be able to execute an incoming request due to its domestic law is when the requesting State seeks to compel testimony from a defendant who has a right pursuant to the Fifth Amendment of the U.S. Constitution not to incriminate himself/herself.

Double criminality is not required by the Law on MLA, which instead merely stipulates that assistance should be provided " in respect of criminal acts the punishment of which, at the time of the request for assistance, falls within the jurisdiction of the requesting State " (article 1, paragraph 2).

If the Security Council does not recommend the applicant State for membership or postpones the consideration of the application, the General Assembly may, after full consideration of the special report of the Security Council, send the application back to the Council, together with a full record of the discussion in the Assembly, for further consideration and recommendation or report. إذا لم يوصِ مجلس الأمن بقبول الدولة صاحبة الطلب في العضوية أو أجل النظر في طلبها، فللجمعية العامة، بعد أن تدرس التقرير الخاص لمجلس الأمن دراسة وافية، أن تُعيد الطلب إلى المجلس ومعه محضر كامل لمناقشته في الجمعية، وذلك للنظر فيه من جديد وتقديم توصية أو تقرير بشأنه.
