1- لا يجوز لدولة أن تحتج بالحصانة من الولاية القضائية أمام محكمة دولة أخرى، تكون من جميع الوجوه الأخرى هي المحكمة المختصة، في دعوى تتصل بعقد عمل مبرم بين الدولة وفرد من الأفراد بشأن عمل تم أداؤه أو يتعين أداؤه كلياً أو جزئياً في إقليم تلك الدولة الأخرى، ما لم تتفق الدولتان المعنيتان على غير ذلك.

" 1. The conciliation proceedings shall begin as soon as possible after the States concerned have agreed in writing to the application of the present rules, with or without amendments, as well as on a definition of the subject of the dispute, the number of members of the conciliation commission, its seat and the maximum duration of the proceedings, as provided in article 24.

2. A State can, however, invoke immunity from jurisdiction in such a proceeding if the States concerned have so agreed or if the parties to the dispute have so provided by an agreement in writing or if the instrument establishing or regulating the body in question contains provisions to that effect.
