Article 9. Extradition of persons who have committed a crime
المادة 9 - تسليم الأشخاص الذين ارتكبوا جريمة ما

Thus, pursuant to article 16 of the Penal Code of the Republic of Tajikistan, the extradition of persons who have committed a crime takes place in the following cases:
فعملا بالمادة 16 من القانون الجنائي لجمهورية طاجيكستان، يحدث تسليم الأشخاص الذين ارتكبوا جريمة في الحالات التالية:

1. Citizens of Turkmenistan who have committed a crime in the territory of a foreign State shall not be subject to extradition to that State.
1 - لا يسلم إلى دولة أجنبية مواطنو تركمانستان الذين ارتكبوا جريمة في إقليم تلك الدولة الأجنبية.

Article 109 stipulates that the Polish penal law shall apply to Polish citizens who have committed an offence abroad.
تنص المادة 109 من القانون الجنائي البولندي على أن القانون ينطبق على المواطنين البولنديين الذين ارتكبوا جريمة في الخارج.

It is anchored in the inalienable rights of the child and promotes the accountability and reintegration of children who have committed an offence through a non-adversarial and voluntary process, based on dialogue and problem solving.

Article 15 of the Criminal Code establishes liability for the citizens or residents of Armenia who committed an offence outside Armenia as long as that they have not been convicted in another country.
والمادة 15 من القانون الجنائي تحدد مسؤولية مواطني أرمينيا، أو الأشخاص المقيمين فيها، الذين ارتكبوا جريمة خارج أرمينيا طالما أنهم لم يدانوا في بلد آخر.

2. Cuban criminal law is applicable to Cuban nationals who commit an offence abroad and are surrendered to Cuba to be tried by its courts pursuant to treaties to which Cuba is a party.

Extradition of persons who have committed a crime
تسليم الأشخاص الذين ارتكبوا جريمة ما

1. Citizens of Turkmenistan who have committed a crime in the territory of a foreign State shall not be subject to extradition to that State.

At the same time, part two, article 16, of the Penal Code provides that foreign nationals and stateless persons who have committed a crime outside the Republic of Tajikistan and are present in its territory may be extradited to a foreign State for the purposes of criminal prosecution or to serve a sentence in accordance with an inter-State treaty.
وفي الوقت نفسه، تنص المادة 16 من الجزء الثاني من قانون العقوبات على جواز تسليم الأجانب أو عديمي الجنسية الذين ارتكبوا جريمة خارج جمهورية طاجيكستان والموجودين داخل إقليمها إلى دولة أجنبية لأغراض محاكمتهم جنائيا أو قضاء مدة العقوبة، وذلك وفقا لمعاهدة مبرمة بين الدولتين.

However, refugee status is denied to persons who have committed a crime against peace, a war crime or a crime against humanity, including one of a terrorist nature, or to persons guilty of acts which run counter to the aims and principles of the United Nations.

In accordance with Article 15 of the Criminal Code, the citizens of the Republic of Armenia, as well as permanent residents, and stateless persons who have committed a crime outside the Republic of Armenia, are subject to criminal liability if the act committed by them is recognized as a crime by the legislation of the state, where it was committed and if they have not been convicted for the same crime in another state.
ووفقا للمادة 15 من القانون الجنائي، يخضع مواطنو جمهورية أرمينيا أو المقيمون الدائمون فيها وعديمو الجنسية الذين ارتكبوا جريمة خارج الجمهورية للمساءلة الجنائية إذا كان الفعل الذي ارتكبوه يعتبر جريمة في تشريعات الدولة التي ارتكب فيها وإذا لم يدانوا لارتكاب نفس الجريمة في دولة أخرى.

The assignment includes the issue of an alternative procedure for people who have committed a crime and who have a developmental disability, autism or similar conditions, or a brain injury that has been sustained in adult life.
139- ويشمل التحقيق مسألة إجراء بديل يطبق على الأشخاص الذين ارتكبوا جريمة والذين هم مصابون بعجز في النمو، أو بالتوحد أو بأمراض مماثلة، أو بإصابات في الدماغ حدثت بعد البلوغ.

2. Foreign nationals and stateless persons who have committed a crime outside the Republic of Tajikistan and are present in its territory may be extradited to a foreign State for criminal prosecution or to serve a sentence in accordance with an inter-State treaty.
2 - يجوز تسليم المواطنين الأجانب والأشخاص عديمي الجنسية الذين ارتكبوا جريمة خارج جمهورية طاجيكستان والموجودين في إقليمها إلى دولة أجنبية لمقاضاتهم جنائيا أو لقضاء مدة عقوبة وفقا لأحكام معاهدة بين الدولتين.

Extradition of persons who have committed an offence
تسليم الأشخاص الذين ارتكبوا جريمة

In accordance with article 13 of the Criminal Code, nationals of the Russian Federation who have committed an offence in the territory of a foreign State are not subject to extradition to that State.
ووفقاً للمادة 13 من القانون الجنائي، لا يخضع رعايا الاتحاد الروسي الذين ارتكبوا جريمة على أراضي دولة أجنبية للتسليم إلى تلك الدولة.

1. Kazakh nationals who have committed an offence in the territory of another State are not subject to extradition to that State unless so established in international agreements.
1 - مواطنو كازاخستان الذين ارتكبوا جريمة في أرض دولة أخرى لا يخضعون لتسليمهم إلى تلك الدولة إلا إذا كان منصوصا على ذلك في اتفاقات دولية.

(a) With regard to the minimum age of criminal responsibility, make sure that children under 16 years of age who have committed an offence and are dealt with through the present procedure only face protective and educative measures;
(أ) فيما يخص الحد الأدنى لسن المسؤولية الجنائية، التحقق من أن الأطفال دون 16 سنة من العمر الذين ارتكبوا جريمة ما والذين يُبَت في قضاياهم باتباع الإجراءات الحالية، لا يخضعون إلا لتدابير وقائية وتربوية؛

3. Ms. Jorgji (Albania) said that the Albanian Criminal Code established Albania's territorial jurisdiction over foreign nationals who committed an offence in the country; active personality jurisdiction for offences committed by Albanian citizens abroad; and protective jurisdiction for specific offences against the interests of the Albanian State or one of its nationals.
3 - السيدة جورجي (ألبانيا): قالت إن القانون الجنائي الألبانية ينص على ولاية ألبانيا القضائية الإقليمية على الرعايا الأجانب الذين ارتكبوا جريمة في البلد؛ والاختصاص الشخصي الإيجابي في الجرائم التي يرتكبها المواطنون الألبان في الخارج؛ والاختصاص الحمائي في جرائم محددة ضد مصالح الدولة الألبانية أو أحد مواطنيها.

Same Article establishes liability for foreign citizens or stateless persons who committed an offence outside Armenia providing that an offence is prosecuted by International Agreements of Armenia or is of grave nature (terrorism is considered as such) directed against the interests of Armenia or the rights or freedoms of its citizens as long as the perpetrators have not been convicted in another country.
والمادة نفسها تحدد المسؤولية بالنسبة للمواطنين الأجانب، أو الأشخاص عديمي الجنسية، الذين ارتكبوا جريمة خارج أرمينيا، شريطة أن تكون المحاكمة عن ارتكاب هذه الجريمة منصوصا عليها في الاتفاقات الدولية لأرمينيا أو أن يكون لها طابع الخطورة (يعتبر الإرهاب من هذه الجرائم) وتكون موجهة ضد مصالح أرمينيا أو حقوق مواطنيها أو حرياتهم طالما أن مرتكبيها لم يدانوا في بلد آخر.

3. Cuban criminal law is applicable to non-resident aliens and stateless persons who commit an offence abroad if they are in Cuba and are not extradited, whether they reside in the territory of the State in which they perpetrate the offence or elsewhere, provided that the offence is also punishable where it was committed.
3 - يسري القانون الجنائي الكوبي على الأجانب والأشخاص عديمي الجنسية غير المقيمين في كوبا الذين ارتكبوا جريمة في الخارج، إذا كانوا موجودين في كوبا ولم يتم تسليمهم، سواء كانوا يقيمون في أراضي الدولة التي ارتُكبت فيها تلك الأعمال أو في أي دولة أخرى، طالما أن ذلك العمل يعاقب عليه في مكان ارتكابه.

4. Where, under the laws of the state requesting the extradition of the persons having committed a crime, such crime is punishable by death penalty, the extradition of the persons having committed the crime may be refused, unless the requesting party gives sufficient assurance that death penalty will not be executed.
4- وإذا كانت قوانين الدولة المطالِبة بتسليم الأشخاص الذين ارتكبوا جريمة تنص على أن عقوبة هذه الجريمة هي الإعدام، جاز رفض تسليم هؤلاء الأشخاص ما لم تقدم الدولة المطالِبة بالتسليم ضمانات كافية بعدم تنفيذ عقوبة الإعدام.
