Subject to the provisions of the present articles, persons concerned having their habitual residence in the territory affected by the succession of States are presumed to acquire the nationality of the successor State on the date of such succession.

Article 8. Persons concerned having their habitual residence in another State

2. A successor State shall not attribute its nationality to persons concerned who have their habitual residence in another State against the will of the persons concerned unless they would otherwise become stateless.

When part of the territory of a State is transferred by that State to another State, the successor State shall attribute its nationality to the persons concerned who have their habitual residence in the transferred territory and the predecessor State shall withdraw its nationality from such persons, unless otherwise indicated by the exercise of the right of option which such persons shall be granted.

For example, article 7, paragraph 2, which did not have a saving clause like the one found in paragraph 1 of the same article, if interpreted literally, required a successor State to attribute its nationality to persons concerned who had their habitual residence in another State against the will of such persons, if they would otherwise become stateless.
فالفقرة ٢ من المادة ٧، التي لا تحتوي على شرط وقائي من تلك الواردة في الفقرة ١ من نفس المادة، تفترض إذا ما فسرت بصفة حرفية أن تعطي الدولة الخلف جنسيتها لﻷشخاص المعنيين الذين يقيمون بصفة اعتيادية في دولة أخرى رغم ارادتهم، إلا إذا كانوا سيصبحون بغير ذلك عديمي الجنسية.

Paragraph 2 dealt with persons concerned who had their habitual residence in a third State and who were not covered by the provisions of article 22, paragraph (b).
وتُعنى الفقرة 2 بالأشخاص المعنيين الذين يقيمون بصفة اعتيادية في دولة ثالثة والذين لا تشملهم أحكام الفقرة (ب) من المادة 22.
