This relates to rule 73 of the rules of procedure; and is set out in paragraph 78 of annex IV to the rules of procedure of the General Assembly.

Annex IV to the Staff Regulations

(h) Payment shall be at the rates specified in annex IV to the Staff Regulations.
)ح( تدفع المنحة بالمعدلات المحددة في المرفق الرابع للنظام اﻷساسي للموظفين.

Should this first option be selected, there is a strong possibility that the reasoning used by the Tribunal with respect to annex IV to the Staff Regulations would eventually be extended to the interpretation of staff regulations 3.2 and 5.3 governing, respectively, eligibility to education grant and home leave.
وإذا أخذ بهذا الخيار اﻷول، فثمة احتمال قوي بأن ينسحب، فيما بعد، تفسير المحكمة اﻹدارية فيما يتعلق بالمرفق الرابع للنظام اﻷساسي للموظفين على البندين ٣-٢ و ٥-٣ من النظام اﻷساسي للموظفين اللذين ينظمان الحق في الحصول على منحة التعليم وإجازة زيارة الوطن، على التوالي.

(b) " Home country " , as used in annex IV to the Staff Regulations, shall mean the country of home-leave entitlement under rule 105.3 or such other country as the Secretary-General may determine.

In July 1994, however, the Administrative Tribunal had issued its Judgment No. 656 which found that the language of annex IV to the Staff Regulations did not support the practice followed by the United Nations and ordered the Secretary-General to pay repatriation grant to the two applicants concerned.
٢٥ - وأضاف أن المحكمة الادارية قد أصدرت في تموز/يوليه ١٩٩٤، حكمها رقم ٦٥٦ الذي يرى أن لغة المرفق الرابع للنظام الاداري للموظفين لا تؤيد الممارسة التي تتبعها اﻷمم المتحدة وأمرت اﻷمين العام بتسديد منحة الاعادة إلى الوطن إلى المدعيين المعنيين.

(b) The following definitions shall be used in ascertaining whether the conditions contained in annex IV to the Staff Regulations and this rule are met:
)ب( تستخدم التعاريف التالية للاستيثاق من الوفاء بالشروط الواردة في المرفق الرابع للنظام اﻷساسي للموظفين وفي هذه القاعدة:

(c) Staff members who are internationally recruited shall be eligible for payment of the repatriation grant in accordance with annex IV to the Staff Regulations if they meet the following conditions:
اﻷهلية )ج( يحق للموظفين المعينين على أساس دولي الحصول على منحة اﻹعادة إلى الوطن وفقا للمرفق الرابع للنظام اﻷساسي للموظفين بشرط الوفاء بالمتطلبات التالية:

(c) Project personnel shall be eligible for payment of the repatriation grant in accordance with annex IV to the Staff Regulations if they meet all the following conditions:
