وعلى عكس ما تنص عليه أحكام المادة ٢١ من " قانون الرعاية النفسانية " الصادر في ١ أيار/مايو ٥٩٩١، فإن الفحص الطبي الذي يخضع له اﻷشخاص قيد التحقيق لتحديد حالتهم العقلية ما زال يُجرى في مؤسسة طبية متخصصة تابعة لوزارة الداخلية.

An investigation carried out by a team of experts from the Center for Torture and Trauma Survivors in Sweden, including specialists in psychiatry, forensic medicine and dermatology, was reported to have confirmed the statements of Cercis Tükenmez regarding his torture and to have found him to be in need of Psychiatric Care.
وقد أُجري تحقيق علي يد فريق خبراء من مركز الناجين من التعذيب والصدمات في السويد من بينه أخصائيون في علم النفس والطب الشرعي وعلم الجلد وأمراضه، أُفيد أنه قد أكد أقوال سرسيس تيكينميز بخصوص تعذيبه وبأنه قد وجده في حاجة إلى الرعاية النفسانية.

The Psychiatric Care Act does, however, contain an exception to this principle if a patient is mentally ill (psychotic) or is in an equivalent state.
غير أن قانون الرعاية النفسانية يتضمن استثناءً من هذا المبدإ إذا كان الشخص مصاباً بمرض عقلي (ذهاني) أو ما شابه.

138. On October 1st 2009, a new Act on Psychiatric Care entered into force, which significantly improved the rights of persons suffering from mental illness.

127. Article 5 of the Psychiatric Care Act states that all persons suffering from mental disorders have, with regard to the Psychiatric Care they receive, the right to:
127- وتنص المادة 5 من قانون " الرعاية النفسانية " على تمتع جميع الأشخاص المصابين باضطرابات نفسية بالحقوق التالية، فيما يتعلق بخدمات الرعاية النفسانية التي تقدم لهم:

A person with a mental disorder may be treated without his/her consent or that of a legal representative only if court-ordered coercive measures of a medical nature are being applied or in the event of involuntary committal to a psychiatric hospital on grounds provided for under article 28 of the Psychiatric Care Act.
ويجوز إخضاع الشخص المصاب باضطرابات نفسية للعلاج دون موافقته أو موافقة ممثله القانوني فقط إذا صدر أمر قضائي باتخاذ تدابير إلزامية ذات طابع طبي وتطبيقها أو في حالة الإيداع غير الطوعي في مستشفى للأمراض النفسية وفقاً للأسس المحددة بموجب المادة 28 من قانون الرعاية النفسانية.

210. Under the Act, anyone diagnosed with a “psychiatric illness” and given Psychiatric Care (a “patient”) enjoys all the same constitutional rights as other citizens unless he or she is legally pronounced incompetent.
٠١٢- ويقضي القانون بأن يتمتع كل من شُخصت إصابته " بمرض نفساني " ويتلقى الرعاية النفسانية ) " المريض " ( بجميع الحقوق الدستورية التي يتمتع بها غيره من المواطنين، ما لم يعلن قانوناً أنه عاجز.

173. In order to bring the mental health regulatory framework into line with human rights standards, a legislative study is being carried out with a view to preparing a draft proposal to update legal provisions in the field of mental health and Psychiatric Care services in institutions within the health sector.
173- ويجري تنفيذ دراسة تشريعية تهدف إلى إعداد مشروع اقتراح لاستكمال النصوص القانونية في مجال الصحة العقلية وخدمات الرعاية النفسانية في بعض مؤسسات قطاع الصحة، من أجل تحقيق اتساق الإطار التنظيمي للصحة العقلية مع معايير حقوق الإنسان.

81. Pursuant to article 5 of the Psychiatric Care Act, all persons with mental disabilities have, with regard to the Psychiatric Care they receive, the right to legal counsel and to be assisted by a legal representative or any other person in accordance with the procedures prescribed by law.
81- وتكفل المادة 5 من قانون الرعاية النفسانية لجميع الأشخاص ذوي الإعاقة الذهنية، فيما يتصل بخدمات الرعاية النفسانية التي تقدم إليهم، الحق في الحصول على محام للدفاع وعلى المساعدة من قبل ممثل قانوني، وكذلك مساعدة شخص آخر، وفقاً للإجراءات المنصوص عليها في القانون.

(c) the possibility of significant harm to their health as a consequence of a worsening psychiatric state if they are left without Psychiatric Care (article 28 of the Act).
