195. It was noted that the draft model provision did not address the issue of the consequences of a disagreement between the contracting authority and the concessionaire on a revision of the concession contract.
195- ولوحظ أن مشروع الحكم النموذجي لا يتناول مسألة الآثار المترتبة على الخلاف الذي يقع بين السلطة المتعاقدة وصاحب الامتياز بشأن تنقيح اتفاق الامتياز.

" Any disputes between the contracting authority and the concessionaire shall be settled through the dispute settlement mechanisms agreed by the parties in the concession agreement [in accordance with the law of this State]. "

It was then suggested that a footnote should be added to the provision for the purpose of reminding enacting States that they might wish to consider the possibility for an extension of the concession contract by mutual agreement between the contracting authority and the concessionaire for compelling reasons of public interest.

15. The Working Group has already examined the possibility for the contracting authority and the concessionaire to agree on the extension of the term of the concession in the concession contract.

152. It was noted that in some cases, in particular in the case of concession contracts concluded under bilateral investment treaties, the contract between the contracting authority and the concessionaire might be governed by public international law instead of the law of the enacting State.
152- ولوحظ أن العقد المبرم بين السلطة المتعاقدة وصاحب الامتياز قد يخضع في بعض الحالات، ولا سيما في حالة عقود الامتيازات المبرمة بموجب معاهدات استثمار ثنائية، للقانون الدولي العام بدلا من قانون الدولة المشترعة.

207. It was observed that the substance of the draft model provision, in particular subparagraph (c), was too stringent, as it did not provide for the possibility for the contracting authority and the concessionaire to agree on the extension of the term of the concession in the concession contract.
207- ولوحظ أن مضمون مشروع الحكم النموذجي، ولا سيما الفقرة الفرعية (ج)، بالغ التشدد إذ أنه لا ينص على امكانية قيام السلطة المتعاقدة وصاحب الامتياز بالاتفاق على تمديد مدة الامتياز في عقد الامتياز.
