المادة 46 الحق في حماية الشرف والكرامة

According to article 7 of the Civil Code a citizen is entitled to take action through the court to refute slanderous or libellous information that is an affront to honour and dignity.
ويحق للمواطن بموجب المادة ٧ من القانون المدني إقامة الدعوى أمام المحاكم لتنفيذ معلومات تنطوي على افتراء أو تشهير يمس الشرف والكرامة.

109. At the same time, the law-enforcement authorities are devoting more and more attention to the investigation of cases relating to breaches of the right to personal honour and dignity and other constitutional rights and freedoms.

Chapters XVII-XXXIII establish the corpus delicti of crimes and misdemeanours, defining the attempts at human life, health, liberty, freedom and inviolability of sexual self-determination, honour and dignity prohibited under law as well as crimes and misdemeanours against children and family, and prescribe penalties for non-compliance with the said prohibitions.

Civil legislation protects non-material benefits, in particular, the honour and dignity of the individual, the right to freedom of movement, the inviolability of the individual (article 150 of the Civil Code of the Russian Federation), article 151 (Compensation for moral damage), article 152 (Protection of honour, dignity and business reputation).

In view of the constitutional right of citizens to defence of their honour, dignity and professional reputation, at present the idea of decriminalizing libel, defamation and insult to the honour and dignity of citizens is not being addressed; one of the main tasks of the Criminal Code is the protection of the rights, freedoms and legitimate interests of individuals and citizens.

124.4 Define criminal offences, in particular those in article 164 of the Criminal Code on incitement to national, ethnic or racial enmity or discord, or insult to the national honour and dignity or religious feelings of citizens, in accordance with international human rights law, and giving special attention to the right to freedom of expression (Brazil);

CERD recommended that Kazakhstan clearly define criminal offences, in particular those in article 164 of the Criminal Code on incitement to national, ethnic or racial enmity or discord, or insult to the national honour and dignity or religious feelings of citizens, so as to ensure that they do not result in unnecessary or disproportionate interference with freedom of expression.
وأوصت لجنة القضاء على التمييز العنصري بأن تحدد كازاخستان بوضوح الجرائم، خصوصاً تلك الواردة في المادة 164 من القانون الجنائي والتي تتناول التحريض على العداء أو الشقاق القومي أو الإثني أو العرقي، أو النيل من الشرف والكرامة الوطنيين أو خدش المشاعر الدينية للمواطنين، بحيث تكفل عدم حدوث تداخل مفرط أو لا لزوم له مع حرية التعبير(122).

The Committee expresses its concern at the overly broad provisions of article 164 of the Criminal Code, such as on incitement to national, ethnic or racial enmity or discord, or insult to the national honour and dignity or religious feelings of citizens, which may lead to unnecessary or disproportionate interference with freedom of expression, including that of members of minority communities (arts. 4 and 5 (d) (viii)).
13- تعرب اللجنة عن قلقها إزاء ما تتسم به أحكام المادة 164 من القانون الجنائي من سعة مفرطة في تناول مسائل مثل التحريض على العداء أو الشقاق القومي أو الإثني أو العرقي، أو الإساءة إلى الشرف والكرامة الوطنيين أو خدش المشاعر الدينية للمواطنين، ما يمكن أن يفضي إلى تداخل مفرط أو لا لزوم له مع حرية التعبير، بما يشمل حرية تعبير أفراد الأقليات (المادة 4 والمادة 5(د)`8`).
