It recommended that the authorities should consider the establishment of accountability mechanisms for private military and security companies at the domestic level.

51. In monitoring the manifestations and emerging trends of mercenaries and mercenaryrelated activities in different parts of the world as well as the effects of the activities of PMSCs on the enjoyment of human rights, the Working Group has identified transnational issues relating to:

76. As to the impact of the employment of private military and security companies on the right to self-determination, attention must be paid to their deployment in the protection of strategic assets that might, for example, involve repressing demonstrations by indigenous peoples or campesinos.

Expresses its appreciation to the Office of the High Commissioner for its support for the holding of the five regional governmental consultations on traditional and new forms of mercenary activities as a means of violating human rights and impeding the exercise of the right of peoples to self-determination, in particular regarding the effects of the activities of private military and security companies on the enjoyment of human rights;

9. The Working Group remains concerned at the impact of private military and security companies on the enjoyment of human rights and, in particular, concerning accountability in case of criminal offences and human rights violations as well as access to remedy for victims of these violations.

52. The Working Group plans to hold regional consultations for the Asia region in October 2009 and for Africa and Western Europe in 2010 to discuss the impact of traditional forms of mercenary activities as well as activities of private military and security companies on the enjoyment of human rights.
52 - ويعتزم الفريق العامل عقد مشاورات إقليمية لمنطقة آسيا في تشرين الأول/أكتوبر 2009، ولأفريقيا وأوروبا الغربية في عام 2010، لمناقشة أثر الأشكال التقليدية لأنشطة المرتزقة، فضلا عن أثر أنشطة الشركات العسكرية والأمنية الخاصة على التمتع بحقوق الإنسان.

61. Pursuant to the request contained in General Assembly resolution 62/145, the Working Group has held regional consultations on traditional and new forms of mercenary activities as a means of violating human rights and impeding the exercise of the right of peoples to self-determination, in particular regarding the effects of the activities of private military and security companies on the enjoyment of human rights.
61 - تنفيذاً للطلب الذي تضمنه قرار الجمعية العامة 62/145، عقد الفريق العامل مشاورات إقليمية بشأن الأشكال التقليدية والجديدة لأنشطة المرتزقة كوسيلة لانتهاك حقوق الإنسان وإعاقة ممارسة حق الشعوب في تقرير المصير، وخاصة فيما يتعلق بآثار أنشطة الشركات العسكرية والأمنية الخاصة على التمتع بحقوق الإنسان.

The Working Group further recommended that it consider the establishment of accountability mechanisms for private military and security companies at the domestic level and ensure that potential victims of human rights violations involving such companies are given access to effective remedies.

The Working Group would like to emphasize its utmost concern at the impact of the activities of PMSCs on the enjoyment of human rights, in particular when operating in conflict, post-conflict or low-intensity armed situations and notes that PMSCs and their personnel are rarely held accountable for violations of human rights.
