The following good practices aim to provide guidance to Territorial States for governing the supply of military and security services by PMSCs and their personnel on their territory.
ترمي الممارسات السليمة التالية إلى تقديم توجيهات إلى دول الإقليم في مجال تنظيم الخدمات العسكرية والأمنية التي تضطلع بها الشركات العسكرية والأمنية الخاصة وموظفوها في إقليم تلك الدول.

2. Each State party shall ensure that PMSCs and their personnel apply due diligence to ensure that their activities do not contribute directly or indirectly to violations of human rights and international humanitarian law.
2- تكفل كل دولة الطرف أن تبذل الشركات العسكرية والأمنية الخاصة وموظفوها العناية الواجبة لكيلا تسهم أنشطتهم بشكل مباشر أو غير مباشر في انتهاك القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي.

The following good practices aim to provide guidance to Home States for governing the supply of military and security services by PMSCs and their personnel abroad ( " export " ).
تهدف الممارسات السليمة التالية إلى توفير التوجيه لدول المنشأ في تنظيم الخدمات العسكرية والأمنية التي تقدمها في الخارج الشركات العسكرية والأمنية الخاصة وموظفوها ( " التصدير " ).

- Each State party shall establish a comprehensive domestic regime of regulation and oversight over the activities in its territory of PMSCs and their personnel including all foreign personnel, in order to prohibit and investigate illegal activities as defined by the convention as well as by relevant national laws.
- تقوم كل دولة طرف بإنشاء نظام محلي شامل للتنظيم والرقابة على الأنشطة التي تقوم بها على أراضيها الشركات العسكرية والأمنية الخاصة وموظفوها بمن فيهم جميع الموظفين الأجانب، وذلك من أجل منع أية أنشطة غير قانونية كما عرفتها الاتفاقية والقوانين الوطنية ذات الصلة، والتحقيق فيها؛

1. Each State party shall ensure that PMSCs and their personnel under no circumstances carry out activities that undermine the sovereignty of another State, its territorial integrity and/or that contravene the principle of sovereign equality and obligation of non-intervention in the domestic affairs of other States and the principle of self-determination of peoples.
1- تكفل كل دولة طرف ألا تنفذ الشركات العسكرية والأمنية الخاصة وموظفوها تحت أي ظرف من الظروف أنشطة من شأنها أن تقوض سيادة دولة أخرى وسلامتها الإقليمية و/أو تخالف مبدأ المساواة في السيادة والتزام عدم التدخل في الشؤون الداخلية للدول الأخرى ومبدأ حرية الشعوب في تقرير مصيرها.

1. Each State party shall take such legislative, judicial, administrative and other measures as may be required to ensure that PMSCs and their personnel import and export their services only under the appropriate licences and authorizations.
1- تتخذ كل دولة طرف ما قد يلزم من التدابير التشريعية والقضائية والإدارية وغيرها لضمان ألا تقوم الشركات العسكرية والأمنية الخاصة وموظفوها باستيراد وتصدير خدماتهم إلا بموجب الرخص والتصاريح المناسبة.

- Each State party shall take such legislative, judicial, administrative and other measures as may be necessary to ensure that PMSCs and their personnel carry out their activities exclusively under the respective licences and authorizations.
- تتخذ كل دولة طرف ما قد يلزم من التدابير التشريعية والقضائية والإدارية لضمان أن تقوم الشركات العسكرية والأمنية الخاصة وموظفوها بأنشطتهم حصراً في إطار التراخيص والأذون الخاصة بها.

2. Each State party shall ensure that PMSCs and their personnel apply due diligence to ensure that their activities do not contribute directly or indirectly to violations of human rights and international humanitarian law.
2- تكفل كل دولة طرف أن تبذل الشركات العسكرية والأمنية الخاصة وموظفوها العناية الواجبة لكي لا تسهم أنشطتهم بشكل مباشر أو غير مباشر في انتهاك القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي.

To require, in consultation with the Territorial State, respect of relevant regulations and rules of conduct by PMSCs and their personnel, including rules on the use of force and firearms, such as:
18 - المطالبة، بالتشاور مع دولة الإقليم، بأن تحترم الشركات العسكرية والأمنية الخاصة وموظفوها الأنظمة ومدونة قواعد السلوك ذات الصلة، بما في ذلك القواعد المتعلقة باستخدام القوة والأسلحة النارية، من قبيل ما يلي:

V. Monitoring compliance and ensuring accountability To provide for criminal jurisdiction in their national legislation over crimes under international law and their national law committed by PMSCs and their personnel and, in addition, to consider establishing:

To provide for criminal jurisdiction in their national legislation over crimes under international law and their national law committed by PMSCs and their personnel and, in addition, consider establishing:

- Each State party shall take such legislative, judicial, administrative and other measures as may be necessary to ensure that PMSCs and their personnel under no circumstances use, threaten to use and/or engage in any activities related to nuclear weapons, chemical weapons, biological and toxin weapons, their components and carriers.
- تتخذ كل دولة طرف ما قد يلزم من التدابير التشريعية والقضائية والإدارية وغيرها لضمان ألا تستخدم الشركات العسكرية والأمنية الخاصة وموظفوها بأي حال من الأحوال الأسلحة النووية والأسلحة الكيميائية والأسلحة البيولوجية والسمّية ومكوناتها وناقلاتها و/أو تهدد باستخدامها و/أو تنخرط في أي أنشطة ذات صلة بها.

6. In the case of PMSCs and their personnel providing military and security services under the agreement as a part of armed forces or military units of the State party, the use of force is regulated by the norms of its military and other respective legislation and relevant international humanitarian law and international human rights law.
6- في الحالات التي تقدم فيها الشركات العسكرية والأمنية الخاصة وموظفوها خدمات عسكرية وأمنية في إطار اتفاق كجزء من قوات مسلحة أو وحدات عسكرية تابعة للدولة الطرف، تحكم استخدام القوة القواعدُ الواردة في القوانين العسكرية وغيرها من القوانين ذات الصلة وبالقواعد ذات الصلة في القانون الإنساني الدولي والقانون الدولي لحقوق الإنسان.

(b) Ensure that PMSCs and their personnel, holding valid licences and authorizations, issued by the competent bodies of the State party to export military and/or security services to carry out single acts or, alternatively, regular activity in the territory of any State not party to the Convention, provide comprehensive information to the competent bodies of all concerned States about the nature and extent of such acts and activities.
(ب) ضمان أن تقوم الشركات العسكرية والأمنية الخاصة وموظفوها الحائزون على رخص وتصاريح سارية المفعول صادرة عن الهيئات المختصة في الدولة الطرف لتصدير خدمات عسكرية و/أو أمنية للقيام بعمل واحد، أو، بدلا من ذلك، القيام بنشاط منتظم في إقليم أي دولة ليست طرفا في الاتفاقية، بتوفير معلومات شاملة إلى الهيئات المختصة في جميع الدول المعنية حول طبيعة هذه الأعمال والأنشطة ونطاقها.
